It shall be unlawful and it is prohibited for any person, firm
or corporation to collect, pick up or remove combustible or waste
materials, scrap metal or other recyclable material by or from stores,
apartments or office buildings, factories or other commercial or manufacturing
establishments or residential dwellings unless and until a license
has been obtained from the Borough as hereinafter set forth.
Applications shall be made in a form to be supplied by the Borough
and shall be issued by the Borough Manager upon the approval of the
collector's application and payment of the collector's license
fees and/or container fee. The license shall be in a form prepared
by the Borough Manager and shall bear a number.
The collector's license number shall be displayed on the
side of the collector's truck. Such display shall be large enough
so that the collector's license number may be visible from a
distance of 50 feet.
No person shall be licensed as a collector unless he provides
a truck in which the combustible and waste materials, scrap metal
and or recyclable materials may be placed in a manner to prevent them
being scattered, blown away or dispersed, or otherwise being a danger
or hazard to the public at large.
All licenses used hereunder by a person other than the licensee
shall cause the license to be revoked.
No collector of any combustible waste material, scrap metal
and/or recyclable material shall operate after sunset or before sunrise
and in no event before 7:00 a.m. or after 7:00 p.m.
Every collector, upon demand of a police officer in uniform,
the Borough Manager or any code official of the Borough of Sharon
Hill, shall permit an examination of the contents of his vehicle or
of any receptacles therein.
Any container 10 cubic yards or larger shall not be left on
Borough streets unless the location is approved by the Police Department
and the container is equipped with reflective markers so it can be
seen at night by passing vehicles. Permission to place waste receptacles
on the Borough streets shall only be given for a maximum period of
72 hours. Extensions of time may only be granted by the Police Department
for a period of 24 hours at a time.
Before any license shall be issued as aforesaid, the collector
shall exhibit to the Borough Manager proof that he carries property
damage insurance in the minimum amount of $500,000 and public liability
insurance of at least $1,000,000, as well as any other insurance required
by federal, state or local laws.
Any person, partnership, association or corporation who shall
be found guilty of violating any of the provisions of this article,
on summary conviction before any Magisterial District Judge, shall
be liable for a maximum fine as provided from time to time by state
statute for each and every violation and, in default thereof, be sentenced
to the county jail not exceeding 30 days for each violation. Each
violation of the provisions of this article shall be considered a
separate offense for each day of duration.
