Within six months from the date this article is enacted, all
banks and other establishments in the Borough of Sharon Hill providing
access to an automated teller machine which is located outside of
a building or other structure shall have installed and have functioning
for the safety of all users of automated teller machines cameras capable
of photographing the general area around the ATM as well as the areas
of ingress and egress to the ATM.
All other retail businesses established after the date of this
article shall install a camera surveillance system that shall view
and record all persons entering and exiting the facility and all persons
who effect any and all transactions.
The location of the cameras required by this article must be
inspected and approved by the Chief of Police or his representative
and the Borough Manager, with periodic inspections to be conducted
by the Chief of Police or his representative and the Borough Manager,
which cameras must be in proper working order. If not in proper working
order, the said establishment shall be subject to fines hereinafter
mentioned.
Any person who shall be convicted of a violation of any of the
provisions of this article before any Magisterial District Judge shall
be sentenced to pay a maximum fine as provided from time to time by
state statute, together with costs of prosecution, or to imprisonment
in the county jail for a term not to exceed 30 days, or both. A separate
offense shall be deemed committed on each day during or on which a
violation occurs or continues.
