As used in this chapter, the following terms shall have the meanings indicated:
LITTER
Any refuse, garbage, rubbish, paper, metal, wood, leaves, glass or any other material or substance which, if thrown, deposited or permitted to collect or remain in any place, public or private, may affect the health, welfare or safety of the public or render streets or public or private places unsightly.
PERSON
Any natural person or any firm, partnership, corporation, association or joint venture.
PUBLIC PLACE
Any and all streets, sidewalks and alleys used by the public and public parks, buildings or grounds.
TOWN
The Town of Belvidere.
No person shall throw or deposit or permit any servant, agent or employee to throw or deposit litter, garbage, refuse or rubbish in or upon any street, sidewalk or other public place within the Town of Belvidere except in public receptacles or in authorized private receptacles for collection.

No person shall deposit garbage or refuse of any kind generated from commercial, industrial or residential properties in public garbage receptacles placed in any public place as defined in this chapter. All privately generated garbage must be deposited in private receptacles.

No person shall sweep into or deposit in or on any sidewalk, gutter, street, catch basin or other public place within the Town any accumulation of litter from any building or lot or from any public or private sidewalk or driveway. Persons owning or occupying property shall keep the sidewalk in front of their premises free from litter. All sweepings of litter shall be collected and properly containerized for disposal.

No person while a driver or passenger in a vehicle shall throw or deposit litter upon any street or other public or private place within the Town. All vehicles shall be properly covered to prevent litter from dropping, sifting, leaking or otherwise escaping.
No person shall put, deposit or throw any litter upon the private property of another.
Nothing in this chapter shall be construed to prohibit the deposit of leaves in a neat and careful manner in the gutter of any street from October 15 to December 1.

The provisions of this chapter may be enforced by the Zoning Official, Police Department, Municipal Clerk/Administrator or other individual designated by the Mayor and Town Council. The minimum fine for any violation of this chapter shall be $100. The Court may impose, in its discretion, a fine up to the statutory maximum of $2,000.
