The words, terms or phrases listed below, for the purpose of
this chapter, shall be defined as follows:
BOARD OF HEALTH
Includes the County Board of Health, its authorized agents
and, if applicable, the Town of Belvidere Health Officer and his authorized
agents.

CONSTRUCTION
Includes the building or constructing or installing of a
new swimming pool or enlarging an existing swimming pool or any of
the facilities.
HEALTH OFFICER
An authorized official employed by the Warren County Board
of Health, and, if applicable, the official(s) employed by the Town
of Belvidere, to enforce the provisions of the State, County or Local
Health Code.

PERSON
Includes corporations, companies, associations, societies,
firms and partnerships as well as individuals.
PORTABLE POOL
Any above-surface type of swimming, bathing or wading pool
and all equipment and appurtenances thereto not designed or intended
to be stationary or permanently fixed but designed and intended to
be removed and stored.
SWIMMING POOL
Any private pool, whether permanently constructed or of the
portable type, having a depth of more than 18 inches above or below
the level of the surrounding land, designed, used and maintained for
swimming or bathing purposes by an individual for use of the members
of the household and guests and located on the applicant's land as
an accessory use to a residence, and shall include all buildings,
equipment, structures and appurtenances thereto.
TOWN OF BELVIDERE
Means Building Inspector or other duly authorized representative
thereof, except in such case when the Town is referred to in a manner
that contemplates action by it as a body.
WADING POOL
Includes any shallow pool not included in the definition
of "portable pool."
All materials used in the construction of swimming pools shall
be waterproof and so designed and constructed as to facilitate emptying
and cleaning and shall be maintained and operated in such manner as
to be clean and sanitary at all times. Inlets shall be so located
and spaced as to secure satisfactory dispersion of in-flowing waters
throughout the pool and permit draining, cleaning and disinfecting
of the bottom and sides. Sand or earth bottoms shall not be used.

A. All swimming pools, including portable pools, shall be so constructed,
installed and maintained as to provide necessary equipment for the
chlorination and other disinfection and filtering in compliance with
approved bacteriological standards as may be promulgated by regulations
issued by the Board of Health and the New Jersey State Department
of Health.
B. The physical, chemical and bacterial qualities of the water of swimming
pools and portable pools shall comply with the regulations and standards
now or hereafter provided in the Sanitary Code of the Town of Belvidere.

All swimming pools shall be not less than 10 feet from side
and rear lot lines and 15 feet from the main building.

A. No swimming pool, portable pool or wading pool shall in any way be
connected to or drained into the sanitary sewer system, under penalty
of a fine of $500 per offense, plus any and all costs to rectify such
occurrence, plus any costs imposed or incurred by the Pequest River
Municipal Utilities Authority.
B. A swimming pool, portable pool or wading pool shall not be permitted
to drain into a public street. The drainage waste shall be dispersed
upon the premises wherein said pool is located or into a sand filtering
pit or as the Board of Health shall require and specify. The discharge
of any wastewater shall in no case cause or create a nuisance in the
abutting property or to the public.
There shall be no physical connection between a potable (public
or private) water supply system and a swimming pool, portable pool
or wading pool at a point below the maximum flow of the pool or to
a recirculating or heating system of a pool unless such physical connection
is so installed and operated that no pool water can be discharged
or siphoned into a potable water supply system.
All swimming pools and portable pools and wading pools referred to in §
444-1 not equipped with facilities for the recirculation and reuse of the pool water may be subject to closure by the order of the Board of Health during any period of emergency water shortage.
Whenever any pool, set forth in §
444-1, by reason of mechanical defects or failure to comply with the requirements of this chapter, is a hazard to the health of users thereof, the Health Officer may summarily close such pool and keep such pool closed until no further hazard to users of the same exists, subject to the right of appeal to the Board of Health by the owner of such pool, which appeal shall not stay the action of the Health Officer.
The Planning Board of the Town of Belvidere may, by resolution,
grant a variance from the terms of the chapter in specific cases,
consistent with public safety and the general provisions and intent
of the chapter; provided, however, that when any question of sanitation
is involved, such variance may be allowed only if the same is also
recommended by resolution of the Board of Health and it has been thereby
determined and declared that such variance will not be harmful to
public health.

Any person violating any provision of this chapter shall, upon
conviction thereof, be punishable by a fine of not more than $500
or by imprisonment for not more than 90 days, or both. Every day that
such violation continues shall be deemed to be a separate offense.

Any person, partnership, corporate entity or association owning,
operating or maintaining a pool within the Town of Belvidere shall,
within 30 days after the effective date of this chapter and annually
thereafter on or before May 1, apply for and obtain from the Town
Clerk an annual pool permit, for which no fee shall be chargeable.
Every permit hereunder shall expire at 12:00 midnight the 30th day
of April following the date of issuance, and no permit shall be transferable.
