A. 
It shall be unlawful to park a motor vehicle or permit the same to be parked on or along any portion of a road located within the Township of Tobyhanna and maintained by the Commonwealth of Pennsylvania that is posted with signs approved by the Pennsylvania Department of Transportation prohibiting parking.
B. 
It shall be unlawful to park a motor vehicle or permit the same to be parked on or along any portion of a Tobyhanna Township road that is posted with Township-approved signs prohibiting parking.
C. 
Designation of no-parking area. It shall be unlawful to park any vehicle at the intersection of Pennsylvania Route 940 and Pennsylvania Route 115 within the Village of Blakeslee, Township of Tobyhanna, Monroe County, Pennsylvania, including, but not limited to, the areas at said intersection that are posted with no-parking signs in each direction of the intersection.
D. 
Parking, stopping and standing prohibited at all times in certain locations pursuant to the Pennsylvania Vehicle Code and locations specifically marked and/or posted.
(1) 
Definitions. Words and phrases used in this article shall have the meaning ascribed to them in the Pennsylvania Vehicle Code, 75 Pa.C.S.A. § 101 et seq., as amended, and the terms "park," "stand" and "stop" shall be defined as follows for purposes of this article:
PARK or PARKING
(a) 
When permitted, the temporary storing of a vehicle, whether occupied or not, off the roadway.
(b) 
When prohibited, the halting of a vehicle, whether occupied or not, except momentarily for the purpose of and while actually engaged in loading or unloading property or passengers.
STAND or STANDING
When prohibited, the halting of a vehicle, whether occupied or not, except momentarily for the purpose of and while actually engaged in receiving or discharging passengers.
STOP or STOPPING
(a) 
When required, complete cessation from movement.
(b) 
When prohibited, any halting, even momentarily, of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic-control sign or signal.
(2) 
Parking, stopping and standing prohibited locations. Except when necessary to avoid conflict with other traffic or to protect the safety of any person or vehicle or in compliance with law or the directions of a police officer or official traffic control device, no person shall:
(a) 
Stop, stand or park a vehicle:
[1] 
Within an intersection.
[2] 
On a crosswalk.
[3] 
At any place where official signs prohibit stopping.
[4] 
At any location where there is an official marking and/or posting prohibiting stopping.
[5] 
Between a safety zone and the adjacent curb within 30 feet of points on the curb immediately opposite the ends of a safety zone, unless a different length is indicated by official traffic-control devices.
[6] 
Alongside or opposite any street excavation or obstruction when stopping, standing or parking would obstruct traffic.
[7] 
Upon any bridge or other elevated structure upon a roadway or within a roadway tunnel.
[8] 
On any railroad tracks.
(b) 
Stand or park a vehicle:
[1] 
Within 20 feet of a crosswalk at an intersection.
[2] 
Within 30 feet upon the approach to any flashing signal, stop sign, yield sign or traffic-control signal located at the site of a roadway.
[3] 
Where the vehicle would prevent the free movement of a streetcar.
[4] 
At any place where official signs prohibit standing.
[5] 
At any location where there is an official marking and/or posting prohibiting standing.
[6] 
In front of a public or private driveway.
[7] 
Within 15 feet of a fire hydrant.
[8] 
Within 20 feet of the driveway entrance to any fire station or, when properly posted, on the side of a street opposite the entrance to any fire station within 75 feet of the entrance.
[9] 
Alongside or adjacent to any curb that has been painted yellow by an authorized representative of the Township and/or state.
[10] 
At any location identified in Subsection D(2)(a) above.
(c) 
Park a vehicle:
[1] 
At any place where official signs prohibit parking.
[2] 
At any location where there is an official marking and/or posting prohibiting parking.
[3] 
Within 50 feet of the nearest rail of a railroad crossing.
[4] 
At any location identified in Subsection D(2)(a) and/or (b) above.
Wherever a space is marked off on any street for the parking of an individual vehicle, every vehicle parked there shall be parked wholly within the lines bounding that space, and it shall be a violation of this article for any person to park a vehicle or allow it to remain parked otherwise.
In the event a motor vehicle is parked on or along any portion of road as set forth above in violation of this article and said motor vehicle is unattended, and the whereabouts of the operator or owner of said motor vehicle cannot be ascertained, proper Township police authorities may direct that said motor vehicle be towed to a site designated by Township authorities, and all costs incurred in towing and storage of the vehicle shall be borne by and the responsibility of the owner and/or operator of said motor vehicle after the identity of the same is determined by appropriate Township officials, and the owner and/or operator shall be subject to the penalties as set forth herein.
Notwithstanding any provisions of this article to the contrary, the parking of any motor vehicle on or along any portion of a road hereinafter defined shall be permitted in the event of an emergency or upon direction of the Pocono Regional Police Department, Tobyhanna Township Volunteer Fire Company or other authorized emergency service organizations existing and operating within the Township.
Any person violating the provisions of this article shall be guilty of a summary offense, and upon conviction thereof, shall be punished by a fine of not less than $35 and not more than $1,000, plus costs, or by imprisonment not exceeding 90 days, or by both such fine and imprisonment. Each day or portion thereof that such violation continues, or is permitted to continue, shall constitute a separate offense.
