Wherever a space is marked off on any street for the parking
of an individual vehicle, every vehicle parked there shall be parked
wholly within the lines bounding that space, and it shall be a violation
of this article for any person to park a vehicle or allow it to remain
parked otherwise.
In the event a motor vehicle is parked on or along any portion
of road as set forth above in violation of this article and said motor
vehicle is unattended, and the whereabouts of the operator or owner
of said motor vehicle cannot be ascertained, proper Township police
authorities may direct that said motor vehicle be towed to a site
designated by Township authorities, and all costs incurred in towing
and storage of the vehicle shall be borne by and the responsibility
of the owner and/or operator of said motor vehicle after the identity
of the same is determined by appropriate Township officials, and the
owner and/or operator shall be subject to the penalties as set forth
herein.
Notwithstanding any provisions of this article to the contrary,
the parking of any motor vehicle on or along any portion of a road
hereinafter defined shall be permitted in the event of an emergency
or upon direction of the Pocono Regional Police Department, Tobyhanna
Township Volunteer Fire Company or other authorized emergency service
organizations existing and operating within the Township.
Any person violating the provisions of this article shall be
guilty of a summary offense, and upon conviction thereof, shall be
punished by a fine of not less than $35 and not more than $1,000,
plus costs, or by imprisonment not exceeding 90 days, or by both such
fine and imprisonment. Each day or portion thereof that such violation
continues, or is permitted to continue, shall constitute a separate
offense.
