As defined in this Chapter, the owner or occupant of any residence,
dwelling unit or any institution, commercial establishment or industrial
facility producing solid waste or recyclables shall provide sufficient
and adequate containers for the storage of said materials. Containers
for such solid waste and recyclables shall be maintained in good repair
and the surrounding area shall be kept in a neat, clean and sanitary
condition at all times and said containers shall be placed and removed
in accordance with the provisions of this Chapter.

A. Solid
waste shall be stored in suitable containers in accordance with the
following requirements:
1. Residential dwelling units. For the purpose of this
Section, the term "residential dwelling unit" shall
include all single-family dwellings and duplexes located within the
City limits of Maryville, but shall not include any dwelling unit
configured larger than a duplex, and shall not include any fraternity
house or commercial apartment complex.
a. Solid waste from a residential dwelling unit may be placed in plastic
bags designed for the purpose of containing such solid waste and may
be placed at curbside or beside the alley on solid waste collection
days. All bags must be securely tied or fastened and shall be maintained
in a manner designed to prevent the scattering of any of the items
contained therein.
b. Solid waste may be placed in a container with a normal capacity of
not less than five (5) gallons and not to exceed forty (40) gallons.
c. The combined weight of any individual container and its contents
shall not exceed seventy-five (75) pounds.
d. Dumpsters, barrels or fifty-five (55) gallon barrels shall not be
used as containers for solid waste.
e. At the discretion of the commercial hauler, on collection days cardboard
may be neatly stacked loose at curbside.
f. All solid waste containers other than plastic bags shall:
(1)
Be leakproof, waterproof and fitted with a fly-tight lid;
(2)
Be properly covered at all times;
(3)
Have handles, bails or other suitable lifting features;
(4)
Be of a type originally manufactured for the purpose for which
it is used;
(5)
Be of lightweight and sturdy construction, such as galvanized
metal or rubber, fiberglass or plastic which will not become brittle
in cold weather.
2. Multi-residential dwelling units. For the purposes
of this Section, the term "multi-residential dwelling unit" shall be understood to include all 3-plex or 4-plex dwelling units
located within the City limits of Maryville, but shall not include
any residential dwelling unit, nor shall it include any fraternity
house or commercial apartment complex larger than a 4-plex.
a. Unless placed in a dumpster as described herein, all solid waste
from a multi-residential dwelling unit must be placed in a container
with a normal capacity of not less than five (5) gallons and not to
exceed forty (40) gallons.
b. Plastic bags containing solid waste must be placed in a container
or dumpster.
c. Barrels or fifty-five (55) gallon drums shall not be used as containers
for solid waste.
d. With the exception of dumpsters, the combined weight of any individual
container and its contents shall not exceed seventy-five (75) pounds.
e. Dumpsters designed to contain solid waste may be used for the collection
of solid waste. Dumpsters shall be located on the residential property
so as not to be visible from adjacent public roadways.
f. At the discretion of the commercial hauler, on collection days cardboard
may be neatly stacked loose at the curbside.
g. All solid waste containers other than dumpsters or plastic bags shall:
(1)
Be leakproof, waterproof and fitted with a fly-tight lid;
(2)
Be properly covered at all times;
(3)
Have handles, bails or other suitable lifting features;
(4)
Be originally manufactured for the purpose for which it is used;
(5)
Be of lightweight and sturdy construction, such as galvanized
metal or rubber, fiberglass or plastic which will not become brittle
in cold weather.
3. Commercial area. For the purpose of this Section, "commercial area" shall be understood to include all other
land-use areas within the City limits of Maryville not defined as
either a residential unit or as a multi-residence dwelling unit. The
term "commercial area" shall include all residential
structures configured larger than 4-plexes and shall include all fraternity
houses, commercial apartment complexes larger than a 4-plex, as well
as all institutional, commercial and industrial establishments.
a. Unless placed in a dumpster as described herein, all solid waste
from a commercial area must be placed in a container with a normal
capacity of not less than five (5) gallons and not to exceed forty
(40) gallons.
b. Plastic bags containing solid waste must be placed in a container
or dumpster.
c. Barrels or fifty-five (55) gallon drums may not be used as containers
for solid waste.

e. Dumpsters may be used for the collection of solid waste if the dumpster
was designed for the purpose of containing solid waste.
f. All containers other than dumpsters or plastic bags shall:
(1)
Be leakproof, waterproof and fitted with a fly-tight lid;
(2)
Be properly covered at all times.
(3)
Have handles, bails or other suitable lifting features.
(4)
Be originally manufactured for the purpose for which it is used;
(5)
Be of lightweight and sturdy construction, such as galvanized
metal or rubber, fiberglass or plastic which will not become brittle
in cold weather.

A. Except
for dumpsters, drums or fifty-five (55) gallon barrels, all solid
waste containers at any location within the City, including plastic
bags, shall comply with the following provisions:
1. Containers of solid waste shall not be placed at the curbside or
beside the alley more than twenty-four (24) hours prior to collection.
2. Plastic bags containing solid waste shall not be placed at the curbside
or beside the alley prior to the day of collection.
3. Within twenty-four (24) hours after collection of solid waste, all
solid waste containers shall be removed from the curbside or from
beside the alley.
4. Except when placed for pickup pursuant to Subsection
(1) of this Section, solid waste containers located on the property shall not be visible from adjacent public roadways.
5. It shall be unlawful to place any solid waste container, including
plastic bags, upon or in any public street, public roadway or alleyway.

It shall be unlawful to burn or attempt to burn any solid waste,
including solid waste located within a container.
