All solid waste and recyclables generated or collected within
the City shall be delivered for disposal purposes to a waste disposal
area or recycling center for which an operating permit has been issued
by the State in which the solid waste disposal area is located.

A. "Normal solid waste" shall be understood to mean all solid
waste which may be received at the Maryville processing facility but
shall not include excludable solid waste, compost material, industrial
process waste or solid waste requiring special handling.
B. The
City shall accept normal solid waste for disposal at its processing
facility subject to the applicable fees and requirements.
C. Items
determined to be industrial process waste, excluded waste or solid
waste requiring special handling, shall not be accepted by the processing
facility unless acceptance is in accordance with the provisions of
this Chapter and the regulations of the Missouri Department of Natural
Resources.

A. The
City may maintain a compost center for the purpose of accepting certain
compost material. Those items which are acceptable shall include items
authorized by the applicable State and Federal regulations including
the following:
B. The
following items shall not be accepted for deposit at the compost center.
11. Any other materials deemed unacceptable by the solid waste area attendant,
City Manager or his/her designated representative.
C. Compost
materials may be delivered to the compost center in any container
for deposit in the designated compost area. The individual delivering
the material shall be responsible for emptying any bags or containers
of compost material at the designated site at the Maryville processing
facility and for depositing the compost as loose material at the designated
site.

A. Industrial
process waste as defined by 10 CSR 80 shall not be accepted at the
Maryville processing facility area unless the City Manager or his/her
authorized representative approves the receipt of the same in accordance
with the provisions of this Section.
B. If
the industrial process waste is additionally determined to be special
solid waste, such waste shall be accepted only in compliance with
the provisions of this Chapter for special solid waste.
C. If
the industrial process waste is additionally determined to be excluded
solid waste, said waste shall be accepted only in compliance with
the provisions of this Chapter for excluded solid waste.
D. If
the industrial process waste is additionally determined to be normal
solid waste, said waste shall be accepted for disposal pursuant to
the provisions of this Chapter for normal solid waste.

A. Special
solid waste shall be solid waste which requires special handling,
special placement or compaction (e.g., tree stumps, logs, branches,
large timbers, wire, domestic animals other than household pets, etc.)
and shall be accepted at the Maryville processing facility only under
the following conditions:
1. The City Manager or his/her authorized representative may impose
pre-delivery processing requirements, such as separation, compaction
or containerization for said waste.
2. Said waste shall be subject to quantity and time of delivery restrictions
as established by the City Manager or his/her authorized representative.
3. Said waste shall be unloaded only as directed by the processing facility
area.

A. Solid
wastes which are excluded by State or Federal law or by City ordinance
will not be accepted at the Maryville processing facility and shall
include the following:
1. Regulated hazardous waste.
2. Radioactive materials and explosives.
3. Regulated infectious waste.
6. Unexpended pesticide containers.
9. Incinerator and air pollution control residues.
10. Industrial process waste and sludge.
11. White goods (e.g., refrigerators, washers, dryers).
13. Non-treated infectious waste.
14. Non-treated bio-hazardous waste.
16. Non-ferrous and ferrous metals.
B. Motor
oil and tires may be received at the Maryville processing facility
in accordance with all applicable State and Federal regulations, upon
payment of the applicable use fees.

A. All
items deposited at the Maryville processing facility, including the
transfer station and the compost center, shall become the sole private
property of the City of Maryville. Any individual, corporation, company
or other entity disposing of items at the Maryville processing facility
or the compost center waives any and all claims to said property upon
delivery.
B. Upon
receipt, the City has the exclusive right to dispose of, salvage or
sell materials received at the Maryville processing facility area
or compost center and to do so in any manner deemed appropriate by
the City of Maryville. Any revenue received from the sale of said
items shall be deposited to the Solid Waste Fund of the City of Maryville,
Missouri.
C. The
City shall not be liable for items of value mistakenly or erroneously
delivered to the Maryville processing facility or compost center.
Anyone delivering or causing to be delivered items to either the Maryville
processing facility or compost center shall be deemed to have accepted
and agreed to these terms.

A. Solid Waste — Normal. All normal solid waste not including
compost material or other items specifically enumerated in the other
provisions of this Chapter shall be subject to a deposit fee of forty-eight
dollars ($48.00) per ton which shall include the current State of
Missouri fee. There shall be a minimum per-load fee of twelve dollars
($12.00) for any vehicle depositing less than five hundred (500) pounds.
The minimum per-load fee shall be prorated for any vehicle depositing
more than five hundred (500) pounds at a rate of forty-eight dollars
($48.00) per ton.

B. Solid Waste — Special Handling. All solid waste requiring
special handling shall be subject to a fee established by the City
Manager or his/her authorized representative. Said fee shall be established
based upon the type of solid waste being received and the manpower
and cost associated with and incurred by the City of Maryville, Missouri,
for said deposit.
C. Industrial Process Waste. All industrial process waste,
as previously defined and described in this Chapter, shall be subject
to a fee established by the City Manager or his/her authorized representative.
Said fee shall be established based upon the type of solid waste being
received and the manpower cost associated with and incurred by the
City of Maryville for said deposit.
D. Waste Tires. The City will only accept sixteen (16) inch
tires or smaller. Tires on rims are not accepted. Sixteen (16) inch
tires or smaller — five dollars ($5.00) each.
E. Waste Oil. There shall be a fee for the deposit of oil at
the rate of twenty cents ($0.20) for each gallon or any part thereof.
F. Wood And Brush. For any wood or brush deposited, there shall
be a fee of thirty-three dollars ($33.00) per ton. There shall be
a minimum fee of seven dollars ($7.00) for four hundred thirty (430)
pounds or less deposited per day. For the purpose of the minimum fee,
multiple loads throughout one (1) day may be accumulated and the hauler
will be charged the minimum fee so long as the total amount of wood
or brush deposited per day does not exceed four hundred thirty (430)
pounds.
G. Compost Materials. Materials accepted for composting will
only be accepted at the compost center. There shall be no fee for
depositing compost material at the compost center.

The City Manager or his/her authorized representative and the
employees of the City on duty at the Maryville processing facility
shall have the authority to issue reasonable verbal or written instruction
to persons utilizing the Maryville processing facility for the purpose
of safety and in order to maintain satisfactory compliance with the
requirements, rules and regulations as contained herein and of the
State of Missouri.

A. The
operation of the Maryville processing facility shall be governed by
the following regulations:
1. Access to site. Access to the area by the public
shall be only at established marked entrances and shall be only during
the hours of operation. It shall be unlawful to gain or attempt to
gain access to the area at any place other than a marked entrance
or at any time other than during regular operating hours.
2. Vehicle operation. Vehicles shall be operated in accordance with posted signs and verbal instruction from the area attendant. Drivers shall be required to follow and stay on marked roads and trails. No person shall drive at a speed greater than ten (10) miles per hour. It shall be unlawful for any person to leave a vehicle unattended at the working face or along any traffic route. All vehicles used for the transportation of solid waste shall be operated and maintained in accordance with Section
220.070.
3. Unloading vehicles. Persons shall be required to
unload their own vehicles. Solid waste and compost shall be unloaded
from the transporting vehicle to the ground in a manner that will
place the solid waste or compost material within the approved area
directly on the working face and not cause it to scatter. It shall
be unlawful to unload a vehicle at any place within the disposal areas
except as directed by signs or the facility attendant. No person shall
unload solid waste or compost from a vehicle if said solid waste or
compost are easily removed by wind in a manner that permits said items
to become airborne. Persons shall unload vehicles containing material
that can become airborne specifically in accordance with the attendant's
instructions.
4. Disturbing containers. It shall be unlawful for
any person unloading solid waste enclosed in a container to open or
otherwise interfere with said container in a manner that permits the
contents thereof to scatter.
5. Inspection of waste. Any person who delivers solid
waste or compost material shall permit the attendant to inspect said
waste or compost in the vehicle by removing covers or moving the waste
or compost or unloading a portion thereof to permit inspection.
6. Segregation of waste. Any person delivering solid
waste or compost material which is not acceptable when mixed with
other waste shall be required to segregate the solid waste or prior
to depositing them at the disposal area. Said segregation of solid
waste or compost material shall take place off site from the Maryville
processing facility.
7. Volume limitations. The City has the right to limit
the volume of any solid waste or compost material that will be accepted
from any one (1) source at any one time or to restrict delivery within
a given period of time from the same source when necessary to maintain
satisfactory compliance with State of Missouri regulations or when
required due to financial considerations, limitations of staff, equipment
or available working face space.
8. Adverse weather conditions. When weather conditions
adverse to the operation of the Maryville processing facility exist,
certain restrictions may be imposed by the City Manager or his/her
authorized representative on the use of the Maryville processing facility
area in order to avoid unsatisfactory conditions. Said restrictions
may include:
a. Prohibition of dumping loose material.
b. Restricting processing facility site use to only solid waste collectors.
c. Other similar measures necessary to maintain satisfactory site conditions.
9. Damaging facilities. It shall be unlawful for any
person to damage, deface, destroy or otherwise alter any facility,
equipment or other property of the City used as a part of the site
development plan or operation of the Maryville processing center.
10. Fires. No person shall set a fire or cause a fire
to burn at the Maryville processing facility area except a City employee
when authorized by the City Manager or his/her authorized representative.
11. Scavenging or salvaging. No private individual,
company or corporation shall engage in scavenging or salvaging operations
at the Maryville processing facility area. Nothing in this provision
shall prohibit a City employee from carrying out operations as directed
by the City Manager or his/her authorized representative pursuant
to ownership rights by the City of Maryville.
12. Trespassing. It shall be unlawful for any person
to enter the transfer station/processing facility area or compost
center except as directed by the area attendant or posted by signs.
13. Safety. It shall be unlawful for any person to engage
in any unsafe practice contrary to the requirements of this Section,
or the instructions of the area attendant or to carry out any actions
at the Maryville processing facility area that may endanger the life,
limb or property of another.

A. It
shall be unlawful for any person to maintain, operate or permit the
operation or maintenance of an open dump or other place at which solid
waste are deposited, except a solid waste disposal area or demolition
solid waste disposal area which is operated under a permit from the
State of Missouri and meets the following additional minimum requirements:
1. Solid waste disposal area. In addition to complying
with Chapter 260, RSMo., any person desiring to operate a solid waste
disposal area within the corporate limits of the City must make application
to the City Manager or his/her authorized representative for the operation
of same and said solid waste disposal area shall meet the following
minimum requirements:
a. Be located in an area which is zoned "M-2" Heavy Manufacturing Zone.
b. Be screened so as to ensure that the area is not visible from any
street right-of-way or residence within one thousand (1,000) feet
of the solid waste disposal area.
c. Be at least two hundred (200) feet distance from any public street,
alley or thoroughfare.
2. Demolition solid waste disposal area. In addition
to complying with Chapter 260, RSMo., any person desiring to operate
a demolition solid waste disposal area within the corporate limits
of the City must make application to the City Manager or his/her authorized
representative for the operation of the same, and said demolition
solid waste disposal area shall meet the following minimum requirements:
a. Be located in an area which is zoned "M-2" Heavy Manufacturing Zone.
b. Be screened from view from any street right-of-way.
c. Be at least two hundred (200) feet distance from any public street,
alley or thoroughfare.
d. Shall not contain concrete, logs or rock exceeding twelve (12) inches
in any dimension. Such demolition debris shall be mixed with soil
in a proportion not to exceed twenty-five percent (25%) debris by
volume.
B. The
application fee for a solid waste disposal area or demolition solid
waste disposal area permit shall be one hundred dollars ($100.00)
payable in advance plus any costs incurred by the City to evaluate
plans for the solid waste disposal area.

A. Facilities
or businesses within the City which collect or process recyclables
as defined by State law shall meet the following guidelines for the
operation thereof. Such facilities shall be located only in an "M-1"
zone and shall meet all requirements and regulations applicable to
such zone.
B. All
recycling collection or processing facilities shall meet or exceed
the following minimum standards:
1. Screening. The operation shall be conducted wholly
within a non-combustible building or within an area surrounded on
all sides by a fence or wall at least eight (8) feet in height. The
fence or wall shall be of uniform height, uniform texture and color
and shall be maintained to insure maximum safety to the public, obscure
the material from normal view of the public and preserve the general
welfare of the neighborhood. The fence or wall shall be installed
in a way that retains all scrap, junk or other materials within the
yard. No scrap, junk or other salvaged materials may exceed the height
of this enclosing fence or wall.
2. Parking. One (1) space for each five hundred (500)
square foot floor area with a minimum of six (6) spaces required.
3. Entrances/traffic circulation. The operation shall
provide entrances on streets with ingress and egress designed to minimize
traffic congestion. There shall be enough room on-site to accommodate
peak traffic volume and company vehicles.
4. Lighting. Lights used to illuminate the premises
shall be so directed and shielded to minimize glare to motorists on
public streets and residents of residential property.
5. Storage bins. Storage bins or trailers may be stored
on-site as an ancillary use, providing the storage bin or trailer
is durable, covered and complies with any setbacks required for any
structure on site. The bin or trailer shall be screened from view
off-site as part of the operation.
6. Loading/unloading. No solid waste, recyclables,
junk or other materials shall be loaded, unloaded or otherwise placed
either temporarily or permanently outside an enclosed building, fence
or visually screened area or within the public right-of-way, except
the use of storage bins placed on the outside an enclosed building
for recycling. The operation shall be attended on the days of operation
to maintain the property in a clean, litter free condition in accordance
with the requirements of the City Code.
7. Paving. All roads, driveways, parking lots and loading/unloading
areas shall be graded and paved with an approved concrete or asphalt/concrete
surface.
8. Stormwater management. Unless otherwise required
pursuant to another provision of the Code, a stormwater management
plan may be required at the discretion of the City.
9. Other regulations. All operations shall be licensed
if required, maintain all proper permits as required from the Missouri
Department of Natural Resources or other licensing authority and shall
meet all City, County, State and Federal requirements pertaining to
facilities, equipment and other features.
