The Police Department of the City of Dardenne Prairie be and
is hereby created and established.

The Police Officers of the City of Dardenne Prairie shall be
appointed by the Mayor with the advice and consent of the Board of
Aldermen as from time to time shall be necessary, and shall serve
for an indefinite term.

A. The
duties of the Police Officers of the City shall be to:
1. It shall be the duty of the Police Officers to faithfully discharge
the duties enjoined on him/her by the laws of the State and by the
provisions of this Chapter and other ordinances of the City. He/she
shall make diligent inquiry and report to the City Attorney for prosecution
all persons who shall violate any provision of the ordinances of the
City and all information and facts coming to his/her knowledge having
reference thereto.
2. It shall be the duty of the Police Officers to inquire into and see
that the provisions of the City ordinances requiring occupation licenses
or vehicle licenses are complied with by all persons engaged in any
business or occupation or operating any automobile or other vehicle,
on which business, occupation, automobile or other vehicle any such
license is imposed by any such provision.
3. The Police Officers shall attend the Municipal Court during the sittings
of such Court, preserve order therein and execute such orders and
process as may be given or directed to him/her by the Court.
4. The Police Officers shall attend all meetings of the Board of Aldermen,
preserve order therein and execute such orders and process as may
be given or directed to him/her by the Board of Aldermen.
5. The Police Officers shall keep accurate accounts in suitable books
of all executions or other process coming into his/her hands, where
the City is a party and upon which money is to be collected.

A. Pursuant
to the provisions of Section 70.820.6, RSMo., granting Statewide arrest
powers for officers in special situations involving immediate dangerous
force, the Police Officers of the City of Dardenne Prairie, while
off duty, are authorized to effect the arrest of individuals anywhere
in the State of Missouri who are observed by the officer in situations
in which deadly force is the only means of protecting the officer's
life or the life of another.
B. The
Police Department general order are as follows:
1. General order, limits of authority.
a. City Police Officers may arrest, on view, and without warrant, at
any place within this State, any person the officer sees asserting
physical force or using forcible compulsion for the purpose of causing
or creating a substantial risk of death or serious physical injury
to any person or any person the officer sees committing a dangerous
felony as defined in Section 556.061, RSMo. Any such action shall
be deemed within the scope of the officer's duties.
b.
Definition. As
defined within Section 556.061, RSMo.:
DANGEROUS FELONIES
Means:
(1)
Arson in the first degree.
(2)
Assault in the first degree.
(6)
Murder in the second degree.
(7)
Robbery in the first degree.
2. General order, department control of weapons. Each
commissioned, full-time officer of the Department, when off-duty and
while within the State of Missouri, may carry a department approved
concealed weapon. This duty is executed in anticipation of the officer
encountering persons involved in the occurrence of dangerous felonies
specifically defined in Section 556.061, RSMo.

A. No
person shall be eligible to be a member of the Police Department of
the City unless such person meets the following minimum requirements
while serving as a Police Officer:
1. Is a citizen of the United States.
2. Is twenty-one (21) years of age.
3. Is a graduate of an accredited high school or has received a certificate
of equivalent education.
4. Is in good physical and mental condition and have a weight commensurate
with height.
5. Is of good moral character.
6. Has no record of a felony conviction or conviction of any crime involving
moral turpitude.
7. Is not an elected public official of any City, County, School District,
Water District, Fire Protection District, Library District or Ambulance
District.
8. Possesses an honorable discharge from any branch of the Armed Forces
of the United States if such member has been a member of the Armed
Forces of the United States.
9. Possesses a valid Missouri motor vehicle operator's or chauffeur's
license.
10. Does not possess a liquor license issued by the State for any establishment
in the County.
11. Passes a thorough and continuing personal background examination
conducted by or on behalf of the City.
12. Has successfully completed all Police training courses required by
State law.
13. Shall not be a member of or employed by any other Police agency or
Department, Fire Department or Fire District, or civil defense unit;
further, shall not be employed to function as a security guard or
to perform watchman services within the corporate limits of the City.

The salary of Police Officers shall be as established from time
to time by Ordinance.

Police Officers may be removed during his/her term of office
only in accordance with Section 79.240, RSMo., dealing with appointive
officers.

All disciplinary actions against any member of the Police Department
shall be conducted in the same manner as disciplinary actions against
any City employee.

The Board of Aldermen of the City may by ordinance enter into
a contract or agreement with any other political subdivision for the
provision of police services by one political subdivision to another
on request as provided for in Section 70.815, RSMo. The terms Chief
of Police," "Law Enforcement," "Law Enforcement Agency," "Law Enforcement
Officer," "Police," "Police Officer," and "Police Department," as
used in the Municipal Code, shall refer to Law Enforcement Officers
of the City or any entity contracting with the City for police services.
