The following words and phrases, when used in this Title, mean:
Any vehicle without current vehicle license, not driveable
without repair or left on property without the consent of the owner
or person in possession of the property.
Any street with a roadway of less than twenty (20) feet.
Any motorized vehicle manufactured and used exclusively for
off-highway use which is fifty (50) inches or less in width, with
an unladen dry weight of six hundred (600) pounds or less, traveling
on three (3) or more low pressure tires, with a seat designed to be
straddled by the operator and handlebars for steering control.
A vehicle of any of the following types as defined in Section
304.022, RSMo.:
Any vehicle operated by the State Highway Patrol, Sheriff or
Deputy Sheriff, Police Departments, Federal Law Enforcement Officer
authorized to carry firearms and to make arrest for violations of
the laws of the United States, Medical Examiner;
Any vehicle operated as an ambulance or operated commercially
for the purposes of transporting emergency medical supplies or organs;
Any vehicle operated under the provisions of Section 307.175,
RSMo., by any member of an organized Fire Department or rescue squad,
whether paid or volunteer;
Any wrecker, tow truck or vehicle owned by a public utility
or public service corporation or by an authorized privately owned
emergency vehicle company;
Any vehicle transporting equipment designed to extricate humans
from wreckage;
Any vehicle designed to perform emergency functions for a Civil
Defense (Homeland Security) or Emergency Management Agency established
under the provisions of Chapter 44, RSMo.

While responding to emergency calls, performing emergency services or in reference to Subsection (1) hereof, while in pursuit of an actual or suspected law violator.

An additional lighting device on a motor vehicle used primarily
to supplement the headlamps in providing general illumination ahead
of a vehicle.
Every vehicle propelled solely by human power upon which
any person may ride, having two (2) tandem wheels, except scooters
and similar devices.
Will be defined at a later date per ordinance.
All streets within the area described by City ordinance as
such.
The City of Dardenne Prairie.
Every vehicle designed, maintained or used primarily for
the transportation of property.
Any area upon or around any roadway which is visibly marked
by the Missouri Department of Transportation, the County of St. Charles,
Missouri, the City or a contractor performing work for the Missouri
Department of Transportation, the County of St. Charles, Missouri,
or the City as an area where construction, maintenance, incident removal
or other work is temporarily occurring. The term "work zone" or "construction zone" also includes the lanes
of roadway leading up to the area upon which an activity described
above is being performed, beginning at the point where appropriate
signs or traffic control devices are posted or placed.
That part of a roadway at an intersection included within the
connections of the lateral lines of the sidewalks on opposite sides
of the highway measured from the curbs or, in the absence of curbs,
from the edges of the traversable roadway;
Any portion of a roadway at an intersection or elsewhere distinctly
indicated for pedestrian crossing by lines or other markings on the
roadway.
A space adjacent to a curb reserved for the exclusive use
of vehicles during the loading or unloading of passengers or materials.
Every person who is in actual physical control of a vehicle.
A major lighting device capable of providing general illumination
ahead of a vehicle.
The entire width between the boundary lines of every way
publicly maintained when any part thereof is open to use of the public
for purposes of vehicular travel.
The area embraced within the prolongation or connection of the
lateral curb lines or, if none, then the lateral boundary lines of
the roadways of two (2) highways which join one another at, or approximately
at, right angles or the area within which vehicles traveling upon
different highways joining at any other angle may come in conflict;
Where a highway includes two (2) roadways thirty (30) feet or
more apart, then every crossing of each roadway of such divided highway
by an intersection highway shall be regarded as a separate intersection.
A roadway which is divided into two (2) or more clearly marked
lanes for vehicular traffic.
Every motor vehicle having a seat or saddle for the use of
the rider and designed to travel on not more than three (3) wheels
in contact with the ground, but excluding a farm tractor.
Any two-wheeled or three-wheeled device, except motorized
scooters, having an automatic transmission and a motor with a cylinder
capacity of not more than fifty (50) cubic centimeters which produces
less than three (3) gross break horsepower and is capable of propelling
the device at a maximum speed of not more than thirty (30) miles per
hour on level ground.
Includes mini-motorcycles, pocket bikes, motorized scooters,
go-carts and any other vehicle that is capable of transporting a person
or persons at a speed in excess of five (5) miles per hour, that is
self-propelled by a gas-powered motor or engine and is not otherwise
defined by Missouri Statues or the City of Dardenne Prairie Code as
a motor vehicle, motorcycle, bicycle or motorized bicycle.
Any two-, three- or four-wheeled device having handlebars
that are attached to a footboard, is designed to be stood upon by
the operator and is powered by a motor that is capable of propelling
the device with or without human propulsion.
Any self-propelled vehicle not operated exclusively upon
tracks, except farm tractors and motorized bicycles.
Whenever certain hours are named herein, they shall mean
standard time or daylight-saving time as may be in current use in
the City of Dardenne Prairie.
All signs, signals, markings and devices placed or erected
by authority of a public body or official having jurisdiction for
the purpose of regulating, warning or guiding traffic.
The standing of a vehicle, whether occupied or not, otherwise
than temporarily for the purpose of and while actually engaged in
loading or unloading merchandise or passengers.
Every motor vehicle designed to transport ten (10) persons
or less but shall not includes trucks, motorcycles or motorized bicycles.
Any person on foot.
Every natural person, firm, co-partnership, association or
corporation.
Any natural person with disabilities that limit or impair
the ability to walk, as determined by a licensed physician as follows:
The person cannot walk fifty (50) feet without stopping to rest;
or
The person cannot walk without the use of or assistance from
a brace, cane, crutch, another person, prosthetic device, wheelchair
or other assistive device; or
Is restricted by lung disease to such extent that the person's
forced respiratory expiratory volume for one (1) second, when measured
by spirometry, is less that one (1) liter or the arterial oxygen tension
is less than sixty (60) mm/hg on room air at rest; or
Uses potable oxygen; or
Has a cardiac condition to the extent that the person's functional
limitations are classified in severity as Class III or Class IV according
to standards set by the American Heart Association; or
Is severely limited in his/her ability to walk due to an arthritic,
neurological or orthopedic condition.
A self-propelled vehicle that is equipped with an internal
combustion engine having a piston displacement of less than fifty
(50) cubic centimeters, is designed to propel itself with not more
than two (2) wheels in contact with the ground, has a seat or saddle
for the use of the operator, is not designed for use on a highway
and is ineligible for a certificate of ownership under Section 301.190,
RSMo.
Shall have the meaning set forth in Chapter 200 of the Municipal Code.

Every way or place in private ownership and used for vehicular
travel by the owner and those having express or implied permission
from the owner, but not by other persons.
An approved device designed and used to give an indication
by reflected light.
The territory contiguous to and including a highway not comprising
a business district when the property on such highway for a distance
of three hundred (300) feet or more is in the main improved with residences
or residences and buildings in use for business.
The right of one (1) driver or pedestrian to proceed in a
lawful manner in preference to another approaching under such circumstances
of direction, speed and proximity as to give rise to danger of collision
unless one grants precedence to the other.
That portion of a highway improved, designed or ordinarily
used for vehicular travel, exclusive of the berm or shoulder. In the
event a highway includes two (2) or more separate roadways, the term "roadway", as used herein, shall refer to any such roadway
separately but not to all such roadways collectively.
The area or space officially set apart within a roadway for
the exclusive use of pedestrians and which is protected or is so marked
or indicated by adequate signs as to be plainly visible at all times
while set apart as a safety zone.

Any street that is not designated as a "snow emergency route".
That portion of a street between the curb lines, or the lateral
lines of a roadway, and the adjacent property lines intended for use
of pedestrians.
Those streets designated as such by St. Charles County.
A highway maintained by the State of Missouri as part of
the State highway system.
The complete cessation from movement; and/or any halting
of a vehicle, even momentarily, except when necessary to avoid conflict
with other traffic or in compliance with the directions of a Police
Officer or traffic control sign or signal.
The entire width between the lines of every way publicly
maintained when any part thereof is open to the uses of the public
for purposes of vehicular travel.
Every highway or portion thereof on which vehicular traffic
is given preferential right-of-way and at the entrances to which vehicular
traffic from intersecting highway is required by law to yield right-of-way
to vehicles on such through highway in obedience to either a stop
sign or yield sign, when such signs are erected as provided in this
Title.
Pedestrians, ridden or herded animals, vehicles and other
conveyances either singly or together while using any highway for
purposes of travel.
Any device, whether manually, electrically or mechanically
operated, by which traffic is alternately directed to stop and to
proceed.
Any motorized vehicle manufactured and used exclusively for
off-highway use which is more than fifty (50) inches but no more than
sixty-seven (67) inches in width, with an unladen dry weight of two
thousand (2,000) pounds or less, traveling on four (4) or six (6)
wheels, to be used primarily for landscaping, lawn care, or maintenance
purposes.

Any mechanical device on wheels designed primarily for use
or used on highways, except motorized bicycles, motorized play vehicles,
motorized scooters, vehicles propelled or drawn by horses or human
power, or vehicles used exclusively on fixed rails or tracks, or motorized
wheelchairs operated by handicapped persons.

A.
The
City of Dardenne Prairie shall keep a record of all violations of
the traffic ordinances of the City of which any person has been charged
and brought before the court to answer said charges, together with
a record of the final disposition of all such alleged offenses. Such
record shall be maintained as to show all types of violations and
the total of each. Said record shall accumulate during at least a
five (5) year period and from that time on the record shall be maintained
complete for at least the most recent five (5) year period.
B.
All
forms for records of violations and notices of violations shall be
serially numbered. For each month and year a written record shall
be kept available to the public showing the disposal of all such forms.
C.
All
such records and reports shall be public records.

Unless another penalty is provided in this Title, it is a misdemeanor
for any person to do any act forbidden or fail to perform any act
required in this Title and upon a finding or pleading of guilt to
any violation of this Title shall be punishable by a fine of up to
five hundred dollars ($500.00) and/ or imprisonment of up to ninety
(90) days in the County Jail, or both the fine and imprisonment; unless
otherwise prescribed by Section 79.477, RSMo.
