A. 
Every person convicted of a traffic infraction as set forth under Article II of Chapter 289 which is not a violation of any provision of the Vehicle and Traffic Law of the State of New York shall, for a first conviction thereof, be punished by a fine of not more than $100 or by imprisonment for not more than 15 days, or by both such fine and imprisonment, and it shall be deemed a violation; for a second conviction within 18 months thereafter, such person shall be punished by a fine of not more than $250 or by imprisonment for not more than 20 days, or by both such fine and imprisonment; upon a third or subsequent conviction within 18 months after the first conviction, such person shall be punished by a fine of not more than $500 or by imprisonment for not more than 30 days, or by both such fine and imprisonment.
B. 
Every person convicted of a parking infraction as set forth under Article IV of Chapter 289 which is not a violation of any provision of the Vehicle and Traffic Law of the State of New York, or otherwise set forth in § 231-21 or 289-38, shall be punished by a fine set forth as follows:

C. 
Persons having been issued a ticket for a parking infraction as set forth hereinabove, except violations related to handicapped parking and § 231-21, and having failed to answer and/or appear on or before the designated return date shall be subject to the following surcharges in addition to the prescribed fines:
(1) 
For failure to answer and/or appear within 30 days: an additional $50, or $100 total.
(2) 
For failure to answer and/or appear within 60 days: an additional $100, or $200 total.
