The parking of vehicles on private roads within the Town of
Riverhead must be addressed by a local law which protects the rights
of property owners abutting private roads while at the same time protecting
the public safety of the Town's residents so that emergency vehicles
have access to residences served by private roads.
Based upon the above-mentioned finding, the Town Board may designate
a portion or all of such private road as a no-parking zone by resolution.
Such resolution shall become effective upon publication in the official
Town newspaper.
Wherever a private road, or portion thereof, has been designated
as a no-parking zone, the Highway Superintendent shall post no-parking
signs along such road.
When parking is prohibited by this Part 2, no person shall park
a vehicle, whether occupied or not, but may stop or stand temporarily
for the purpose of and while actually engaged in loading or unloading
merchandise or passengers. A violation of this Part 2 shall be a traffic
infraction punishable by a fine not to exceed $25.
Whenever a resolution of the Town Board has been adopted as
provided herein, it shall be lawful for police officers to enter upon
such private road for the purpose of enforcing the no-parking restrictions.
