The regulations for and control of the taking of shellfish and
finfish from the waters and lands under waters in the Town of Riverhead
are deemed necessary to protect the propagation of such shellfish
and finfish, to preserve public peace and good order and to protect
the public health and welfare. These regulations may be superseded
by 6 NYCRR Part 44, Lobster and Crabs, of the Environmental Conservation
Law.

A. Access to the East Creek shall be seasonal and dependent upon advisement
from the New York State Department of Environmental Conservation on
a yearly basis. The date range of allowable activity is subject to
change and shall be reflected on the annual shellfish permit issued
by the Town Clerk.
B. If the East Creek is open, permittees may only remove shellfish during
the hours of 9:00 a.m. through 3:00 p.m., Monday through Friday, no
weekends or holidays. Removal of shellfish on dates outside of the
annual season as prescribed by the New York State Department of Environmental
Conservation shall be prohibited.
C. The taking of shellfish shall be limited, on a daily basis, to a
1/2 bushel of individually combined shellfish, of which no more than
100 shall be hard clams.
D. Commercial removal of shellfish and/or finfish from the waters of
the East Creek shall be prohibited.
E. Removal of shellfish from the waters of the East Creek by a non-Riverhead
resident shall be prohibited.
Starfish, drills, drum fish and moon snails, when taken, shall
not be returned alive to the waters of the Town of Riverhead.
No shrimp shall be taken from the waters of the Town of Riverhead
by the use of any dredge, except by the light shrimp dredge and except
by the minnow seine.
The limits for taking shellfish shall be as follows:
A. Escallops.
(1) Commercial resident/taxpayer permittees may take five bushels per
day. Two or more such persons occupying the same boat while taking
escallops may take, in the aggregate, not more than 10 bushels in
one day.
(2) All other permittees may take individually one bushel per day.
B. All other shellfish as defined herein, except escallops.
(1) Commercial residential/taxpayer permittees: limit of five bushels.
(2) All other permittees may take individually 1/2 bushel of combined
shellfish, of which no more than 100 may be hard clams.
C. Whenever the total catch on board a vessel exceeds the authorized
limit, all persons on board shall be deemed in violation.
This Part
4 shall be enforced by any duly constituted law enforcement agency having jurisdiction within the Town of Riverhead.
