There shall be constituted within the City a Fire Department, which shall be known and designated by the name of the Fredericktown Fire Department.

The Fire Department shall be composed of a minimum of fifteen (15) first call members, one (1) of whom shall be Chief, and shall be appointed by the Board of Aldermen. The Mayor and members of the Board of Aldermen of the City shall constitute a Board of Trustees, who shall have charge of the equipment and apparatus and see that such equipment and apparatus is properly taken care of, and the Board of Trustees shall have the authority to increase the number of the first call members of the Fire Department as it may deem necessary and to further determine the amount of compensation received.

The members of the Fire Department, under the direction of the Chief and his/her assistants, shall have access to and control of all equipment and apparatus possessed by and belonging to the City for the purpose of fighting fires or of preventing fires, at all times, during any fire or for practice. The members shall exercise care and handle such equipment and apparatus in a prudent manner. They shall see that such equipment and apparatus is kept in a constant state of readiness and efficiency and shall promptly report to the Board of Trustees any damage thereto.

All business affairs and financial affairs of the City Fire Department shall be subject to the supervision and direction of the Board of Aldermen, and the equipment, supplies and other items that require expenditure of funds for the City Fire Department shall be requested by a requisition order directed to the Board of Aldermen. Such items shall be purchased only after approval by the Board of Aldermen.

The placing of control of the management of the business affairs of the City Fire Department in the Board of Aldermen shall relate solely to business affairs; the internal management and decisions of the Fire Department as they relate to procedure and methods of maintaining equipment, fire fighting and other operational decisions shall be made by the Fire Department in accordance with existing Statutes and the Constitution, by-laws and other regulations of the Fire Department.

The Chief or other officer or members of the Fire Department shall confer from time to time with the Trustees as to any improvement in the efficiency of the department or the equipment or as to new equipment, but all contracts for the purchase of new equipment or material shall be approved by the Mayor or Board of Aldermen of the City.

It shall be the duty of the Secretary of the Fire Department to furnish the City Clerk annually, on or about November 1, a certified list of the names of all members of the department in good standing, and other data that might be of help to the Board of Aldermen.

The Board of Aldermen may purchase or cause to be purchased group accident insurance or similar insurance covering the members of the Fire Department while on duty in the department.

A. 
The City hereby declares its intent to become a member of MFFCIT and to participate thereof upon approval of the Board of Trustees of MFFCIT.
B. 
That the Mayor and Board of Aldermen for the City of Fredericktown, Missouri, approve the Trust and Pool Agreement marked Exhibit "A" and By-Laws marked Exhibit "B,"[1] which are attached hereto and incorporated herein as if fully set forth, between the City of Fredericktown and the members of the MFFCIT Pool. It is the belief of the Mayor and Board of Aldermen that it is in the best interest of the citizens of the City of Fredericktown, Missouri, that the City enter into said agreement and by-laws.

C. 
That the Mayor be and he/she is hereby authorized to execute all documents necessary or expedient for the City to participate in the MFFCIT, including the agreement in substantially the form as Exhibit A, to Ord. No. 23-22, and the by-laws in substantially the form as Exhibit B, to Ord. No. 23-22, agreeing to adhere to the rules of said documents and to be bound together with other members thereby.
