The title of this chapter shall be the "Animal Control Code."
The purpose of this chapter is to:
A. Promote the health, safety and general welfare of the Tribe, its
citizens and visitors to the Tribe's Reservation;
B. Govern the activities of all persons who own, possess or have custody
of animals on the Reservation of the Nottawaseppi Huron Band of the
Potawatomi by incorporating and applying the laws of the State of
Michigan as tribal law to such activities; and
C. Provide for tribal regulation of activities related to the ownership,
possession or custody of animals by all persons within the territorial
jurisdiction of the Tribe.
If any provision of this chapter is found to be unconstitutional
or unlawful by the Courts of the Tribe or the federal courts, such
provision(s) shall be struck and the remainder of this chapter shall
continue in full force and effect.
This chapter shall take effect thirty (30) days after its approval
and following posting at all tribal government buildings.
In its interpretation and application, the provisions of this
chapter shall be held to be minimum requirements and shall be liberally
construed in favor of the Tribe and shall not be deemed as a limitation
upon or repeal of any other Tribal power or authority.
The Tribe declares that there is no liability on the part of
the Tribe, its agencies, agents or employees for any damages which
may occur as a result of reliance upon or conformity to this chapter.
The Tribe by the adoption of this chapter does not waive its sovereign
immunity in any respect.
