If any provision of the Charter is determined by a court of
competent jurisdiction to be invalid or otherwise ineffective, the
remainder of this charter shall remain effective, and the provision
at issue will be construed in such manner as will give it the maximum
scope of its intended effectiveness, if any, within the terms of the
court's decision, provided that in no event shall determination of
the invalidity or ineffectiveness of any provision impair any contract
entered into by the Authority prior to such determination.
This charter may be amended or revoked only upon a resolution duly adopted by the Tribal Council providing for dissolution pursuant to Article
VIII, provided that in no event shall any amendment or revocation impair any contract entered into by the Authority prior to the effective date of such amendment or revocation, nor shall any revocation be effective during any period during which the Authority is indebted for borrowed money unless the conditions to dissolution stated at §
11.1-31 above are satisfied.
This charter is immediately effective upon adoption by the Tribal
Council and shall remain in effect until amended or revoked by the
Tribal Council in accordance with the terms of this charter.
