The Police Department of the City of Bourbon shall consist of the Chief of Police, all regular Police Officers of the City of Bourbon, all reserve Police Officers of the City of Bourbon, and all other City employees that may from time to time be assigned to the Department by the Board of Aldermen. The Police Department of the City of Bourbon shall function as the Police force of the City of Bourbon.

A. 
The Chief of Police shall keep an arrested offender in a proper place to prevent his/her escape until a trial can be had before the proper officer, unless such offender shall give a good and sufficient bond or other recognizance to assure his/her appearance at the place and time for which his/her trial is set.
B. 
The Chief of Police shall have the power to at all times make or order an arrest, with proper process and within the City limits of the City of Bourbon for any offense against the laws and ordinances of the City of Bourbon.
C. 
Acting Chief. During sickness, absence from the City or other temporary disability, the Mayor shall designate a member of the Police Department to act in the stead of the Chief of Police and perform his/her duties.

D. 
General Duties Of Chief of Police.

The Chief of Police shall familiarize himself with and obey all ordinances and recorded orders of the Board of Aldermen. He/she shall see that no violations of same are tolerated. He/she shall supervise the enforcement of all City ordinances, the enforcement of which is not vested in other City officers or employees. He/she shall make written monthly reports to the Board of Aldermen on the activities of the Police Department.

The Chief of Police shall report any unusual activity within the City or the Police Department as soon as possible to the Mayor or City Clerk, whom shall then inform the Board of Aldermen.
3. 
The Chief of Police shall keep a record of his/her acts and orders and shall file in his/her office all petitions, documents and papers belonging thereto. Copies of such records, petitions, documents and papers, when certified by him/her, shall be prima facie evidence in any court of the facts therein contained.

A. 
The Police of the City may be appointed in such numbers, for such times and in such manner as may be prescribed by ordinance. They shall have power to serve and execute all warrants, subpoenas, writs or other process and to make arrests. They may exercise such powers in areas leased or owned by the municipality outside of the boundaries of such municipality. The Police shall be conservators of the peace and shall be active and vigilant in the preservation of good order within the City.
B. 
The Police Force of the City may be increased up to nine (9) officers who shall be the conservators of the peace and shall be active and vigilant in the preservation of good order within the City.

A. 
The term of the appointment of such regular Police Officers shall be upon such conditions and length as the Board of Aldermen may prescribe; and the Board of Aldermen shall have the power to fix the compensation of all Police Officers so appointed.
B. 
The starting salary of a Bourbon Police Officer shall be twelve dollars and fifty cents ($12.50) per hour. After six (6) months of documented progress, the officer's salary will be raised to thirteen dollars ($13.00) per hour. After an additional six (6) months of documented progress, the officer's salary will be raised to thirteen dollars and fifty cents ($13.50) per hour. Any additional salary increases would be given at the beginning of the fiscal year and based upon the officer's written performance evaluation and the approval of the majority of members of the Board of Aldermen.

C. 
All part-time Police Officers of the City of Bourbon will be compensated at thirteen dollars and fifty cents ($13.50) per hour. The part-time Police Officers' total hours worked shall not exceed thirty (30) hours within a pay period. Part-time Police Officers will not be eligible for City-offered benefits, such as holiday pay, sick pay, vacation pay, family medical leave and health benefits.

A. 
The Mayor, with the consent and approval of a majority of the Board of Aldermen, shall have the power to appoint persons as reserve Police Officers.
B. 
Such reserve Police Officers shall serve without compensation.
C. 
Such reserve Police Officers, unless certified as a Peace Officer under the provisions of Chapter 590, RSMo., shall have no power of arrest and, unless certified as a Peace Officer under the provisions of Chapter 590, RSMo., must be under the direct supervision of a certified Peace Officer of the City of Bourbon at all times while on duty.

Each person appointed to be a regular or reserve Police Officer of the City of Bourbon shall, before entering upon the duties of Police Officer, take and subscribe to an oath or affirmation before the City Clerk that he/she possesses all of the qualifications prescribed by such office by law; that he/she shall support the Constitution of the United States and of the State of Missouri, the provisions of all laws of this State affecting Cities of the Fourth Class and the ordinances of the City of Bourbon, Missouri, and shall faithfully demean himself/herself while in office; which official oath or affirmation shall be filed with the City Clerk.

A. 
Any full-time Police Officer of the City of Bourbon, Missouri, who completed the basic police training program as established by Chapter 590, RSMo., shall have the authority to respond to an emergency situation outside the boundaries of the City.
B. 
No Police Officer shall be required by reasons of this Section to leave the jurisdiction to respond to an emergency situation, but said Police Officer shall use his/her discretion and judgment as to leaving the City to respond to any emergency situation. It shall be the policy of the City that said Police Officers shall not leave the City inhabitants with inadequate police protection or be absent for extended periods of time, but that the response shall be in aid of and to assist any governmental authority in which the emergency situation is located.
C. 
The authority contained herein shall permit the response by one (1) or more City Police Officers in an area surrounding this municipality with a radius of ten (10) miles. The Chief of Police may in his/her discretion authorize additional response beyond this area. The governing body of the political subdivision in which the emergency situation is alleged to be occurring shall have first authorized such response by ordinance, order, or other ruling.
D. 
Every response to an emergency situation outside of the City shall be reported by the Chief of Police to the Mayor with an explanation of the reason for the response.
E. 
Definitions. As used in this Section, the following terms shall mean:
EMERGENCY SITUATION
Any situation in which the Police Officer has a reasonable belief that a crime is about to be committed, is being committed, or has been committed involving injury or threat of injury to any person, property, or governmental interest and such officer's response is reasonably necessary to prevent or end such emergency situation or mitigate the likelihood of injury involved in such emergency situation. The determination of the existence of any emergency situation shall be in the discretion of the officer making the response or in the discretion of an officer or governmental officer of the political subdivision in which the emergency situation is alleged to be occurring.
RESPONSE
To take any and all action which the officer may lawfully take as if exercising his/her powers within his/her own jurisdiction.
F. 
In addition to the powers prescribed in this Section, Section 544.216, RSMo., and any other arrest powers, a Police Officer may arrest on view, and without a warrant, at any place within this state, any person the officer sees asserting physical force or using forcible compulsion for the purpose of causing or creating a substantial risk of death or serious physical injury to any person, or any person the officer sees committing a dangerous felony as defined in Section 556.061, RSMo. Any such action shall be deemed to be within the scope of the officer's employment.
