As used in this Chapter, the following words have the meanings
indicated:
FARMERS' MARKET
A market held in an open area or in a structure where farmers'
market vendors offer for sale to the public such items as unprocessed
foodstuffs, produce, home-processed food products, homemade handicrafts,
and items customarily sold or dispensed at farmers' markets from
booths or vehicles on site.
FARMERS' MARKET MANAGER
The person accepting responsibility for the organization,
supervision and reporting of the farmers' market.
FARMERS' MARKET VENDOR
The individual farmers, producers or such other persons selling
unprocessed foodstuffs, produce, home-processed food products, homemade
handicrafts, and items customarily sold or dispensed at farmers'
markets on a seasonal basis in a farmers' market.
HANDICRAFTS
Items made by hand, often with the use of simple tools, and
are generally artistic and/or traditional in nature. They are also
objects of utility and objects of decoration.
PERSON
Any individual, copartnership, firm, association, company
or combination of individuals, of whatever form or character.
PRODUCE
Fruits, vegetables, honey, eggs, grain, flowers, herbs, plants,
and other similar items. Produce does not include live animals of
any sort, slaughtered animals, unrefrigerated meat, fish and poultry.

A. Any person wishing to operate a farmers' market within the City
must obtain a license pursuant to the requirements of this Chapter.
Each such license shall be in effect for one (1) calendar year commencing
on January 1 of each year.
B. An applicant for a license to operate a farmers' market pursuant
to this Chapter must file with the City a completed application form
which shall include, but not be limited to, the following information:
1.
Name of the person applying for the license. If the applicant
is a company, the application must provide proof of good standing
with the Missouri Secretary of State. If the organization is a non-profit
corporation, the organization must provide proof of its tax status
with the Internal Revenue Service.
2.
The home address of the applicant or address of the registered
agent, if the applicant is a company.
3.
A description and drawing of the proposed farmers' market,
including, but not limited to location of vendors, ingress and egress
onto and off of public roadways and proposed restroom facilities,
if provided.
4.
The designation of an individual as a farmers' market manager,
including the name, address, e-mail address and telephone number of
the farmers' market manager.
5.
A statement that the property at which the farmers' market
is to be located is appropriately zoned for such use.
6.
The proposed season of operation, days of operation and hours
of operation. An application can be submitted for any season, including
spring, summer, fall and winter.
7.
An initial report containing the information required in Section
620.030.
8.
The license fee as set forth in Section
605.020 of this Code.

A. After approval of a farmers' market license, the farmers'
market manager shall provide the following information to the City
at least twenty-four (24) hours prior to each farmers' market
vendor operating at the farmers' market for the first time in
a calendar year:
1.
The name, address and telephone number of the farmers'
market vendor.
2.
The address of the farm, garden or residence from which the
products being sold originate.
3.
A sworn statement that the farmers' market vendor is knowledgeable
of and possesses all necessary City, County and State permits and
licenses applicable to the products being sold by them or their representatives
and that the farmers' market vendor has or will pay all applicable
City, County or State sales tax.
4.
A signed acknowledgment of the rules and regulations of the
farmers' market by the farmers' market vendor.
B. Each report submitted consistent with the requirements of this Section after the initial report required in Section
620.020(B)(7) shall be accompanied by a fee of two dollars ($2.00) per farmers' market vendor listed.

A. In addition to the rules established by the farmers' market
manager, it shall be the responsibility of the individual farmers'
market vendor to ensure that:
1.
All produce sold at the farmers' market is in a fresh and
healthy condition.
2.
The sale of produce by commercial growers or producers is expressly
prohibited.
3.
The farmers' market is not used by persons offering goods
or produce for resale.
4.
No animals or livestock are offered for sale at the farmers'
market.
5.
At the close of the business day, each farmers' market
vendor in the farmers' market clears the area assigned him and
removes all refuse.
6.
The City or its agents shall be permitted to inspect the grounds,
vehicles and all items for sale at the farmers' market at any
reasonable time.
