No fences, gates or other structure or obstructions may be constructed,
or maintained, on or over seawalls located in the Town without the
express written approval of the Select Board. Those seawalls that
are privately owned and maintained will be exempted from the provisions
of this bylaw. The Select Board may, in its sole discretion, rescind
said permission if it determines it is in the Town's best interest
to do so.

Any person who erects, maintains or suffers to be maintained
any such structure without permission to do so shall be punished by
a fine of $50 per day. Each day or portion thereof during which a
violation continues shall constitute a separate offense. Such fine
may be recovered on complaint in the District Court which sum shall
enure to the general use of the Town. This bylaw may also be enforced
pursuant to MGL c. 40, § 21D, by a Town police officer or
other officer having police powers.
