Any person in violation of this article shall be fined a sum
of $25 per dog for each day the kennel is kept.

A kennel may be operated exclusively in agriculturally zoned
areas with setbacks from all abutting property of not less than 100
feet.

There shall be kept no more than 10 dogs at any licensed kennel
within the Town.

No license fee shall be imposed on any pedigree dog kept for
breeding and stud purposes only, provided the dog shall be owned by
a breeder or annual exhibitor of pedigree dogs and be housed in a
breeding kennel duly licensed in accordance with the provisions of
this article. The dogs shall be allowed at large solely in the accompaniment
of the owner or keeper of such kennel.

(a) Contents. Every owner or keeper of pedigree dogs may make application
to the Town Clerk for a kennel license, the application stating the
following:
(1)
The names of the owner and keeper of the kennel.
(2)
The proposed location of the kennel.
(3)
The number of dogs to be kept in the kennel.
(4)
The dogs are to be kept for breeding and stud purposes only.
(b) Proof of vaccination. Proof of rabies vaccine must be provided at
time of application.

After application for a kennel license, the Town Clerk shall
refer the matter to the department of animal control for inspection
and recommendation as to whether the kennel is in accordance with
the public safety. Upon such findings, the Town Clerk may issue a
kennel license authorizing the owner or keeper to hold the kennel
in the specified location, subject to an application fee to be paid
at the time of application in an amount established from time to time
by the Town Council and on file in the office of the Town Clerk.

All monies received from kennel licenses shall be credited to
the Town's general fund.

Every kennel license shall be for a period of one year, expiring
on April 1 following the date of issuance.

The number of kennel licenses to be issued in the Town shall
not exceed 10.
