A. 
Compliance with rules. All persons now receiving a water supply from the Utility, or who may hereafter make application therefor, shall be considered as having agreed to be bound by all rules and regulations as filed with the State Public Service Commission.
B. 
Public Service Commission rules adopted. The following provisions of Wis. Admin. Code ch. PSC 185 are adopted by reference and made a part of this chapter as if set forth in full. A violation of any such rules shall constitute a violation of this section and shall be punishable as provided in § 223-31.

Water Utility operating rules adopted.[1]
(1) 
The Water Utility shall operate pursuant to the Village of Waterford Water and Sewer Utility Water Rates and Rules approved by the Wisconsin Public Service Commission, including the Water Utility Operating Rules, Schedule X-1, as may be amended from time to time, which are adopted as though fully set forth herein, and which shall be kept on file in the offices of the Village Clerk and the Water Utility, and at the Village of Waterford Public Library. A violation of these rules shall constitute a violation of this section and shall be punishable as provided in § 223-31.

The following specifications apply in addition to the PSC operating rules adopted in this chapter:
A. 
Service connections and laterals.
(1) 
Duplexes may be served by one lateral, provided individual metered service and disconnection is provided.
(2) 
All service pipe shall be laid not less than six feet below the surface of an established or proposed grade line. When laid in a combined sewer and water trench, the service pipe shall be laid on a shelf of solid ground not nearer than 12 inches to the side wall of the sewer trench.
(3) 
No water supply pipe to the furthermost riser or fixture branch shall be of a smaller diameter than one inch.
B. 
Developers' connection charges. A connection charge for premises not previously connected to the water main shall be paid, in an amount set by the Village Board, and imposed upon developers pursuant to developer's agreements entered into under Chapter 235, Subdivision of Land, of this Code.
C. 
Meters.
(1) 
Service for meter settings. Where a meter of one inch or less is to be installed, a meter horn of a size appropriate to the meter used shall be installed by the owner. For meters greater than one inch, the meter setting shall be inspected and approved by the Utility.
(2) 
No permission shall be given to change from metered to flat rate service.
(3) 
In multiple-use buildings where the uses are divided into distinct units, separate meters shall be installed for business and residential uses.
D. 
Valves. All valves, be they altitude, gate, globe, check, pressure relief or otherwise, within the public or private street right-of-way lines and two inches in size or over shall be installed inside a standard manhole, which shall be 48 inches in inside diameter, of concrete construction, providing sufficient clearance on all sides and bottom of the valve for maintenance and operation and equipped with a cast-iron frame and cover, or within a valve box, according to the current edition of Standard Specifications for Sewer and Water Construction in Wisconsin, at the discretion of the Director of Public Works.
E. 
Extensions.
(1) 
All extensions of the water system shall be constructed according to the current edition of Standard Specifications for Sewer and Water Construction in Wisconsin, as may be amended from time to time, the size thereof to be determined by the Utility; however, no extension shall be of less than eight-inch pipe.
(2) 
Dedication to the public. Any water system which is to be dedicated to the public shall be constructed to public water utility standards as set forth in the Wisconsin Statutes and Administrative Code. No system which is constructed to private system standards shall be dedicated to the public.
F. 
Right to open hydrants. Only persons authorized by the Director of Public Works or the Fire Department shall be permitted to open any fire hydrant for any purpose, and no one except such persons may take the hydrant wrenches or wheels or allow the same to be taken from any fire house, except for Fire Department purposes.

A. 
Billing.
(1) 
Bills for water service are rendered quarterly and become due and payable on the first of the month following the period for which service is rendered. A late payment charge as set per § 223-7 will be added to bills not paid within 20 days of issuance. This one-time late payment charge will be applied only to any unpaid balance for the current billing period's usage. This late payment charge is applicable to all customers. The utility customer may be given a written notice that the bill is overdue no sooner than 20 days after the bill is issued. Unless payment or satisfactory arrangement for payment is made within the next 10 days, service may be disconnected pursuant to Wis. Admin. Code ch. PSC 185.
(2) 
Failure to receive a bill shall not exempt consumers from the provisions of Subsection A(1).
B. 
Unit of service defined.
(1) 
A unit of service shall consist of any aggregation of space or area occupied for a distinct purpose, such as a residence, apartment, flat, store, office or factory, which is equipped with one or more fixtures for rendering water service, separate and distinct from other users. Each unit of service shall be regarded as one consumer, and the surcharge for additional consumers on a meter shall be assessed accordingly.
(2) 
Suites in houses, or apartments where complete housekeeping functions (such as cooking) are not exercised, shall be classed as rooming houses. Thus, houses and apartments having suites of one, two or more rooms with toilet facilities but without a kitchen for cooking are classed as rooming houses.

No person shall enter a claim against the Village as a water utility, or any officer thereof, for damage to any pipe, fixture or appurtenance by reason of interrupted water supply or variation of pressure or for damage caused by the turning off or turning on, either wholly or partially, of the water supply for the extension, alteration or repair of any water main or premises supply or for the discontinuance of the premises water supply for the violation of any rules or regulations of the Water Utility. No claims shall be allowed against the Village on account of the interruption of the water supply caused by the breaking of pipes or machinery or by stoppage for repairs or on account of fire or other emergency; and no claims shall be allowed for any damage caused by the breakage of any pipe or machinery.

The rates and fees for water, service and equipment provided by the Village of Waterford Water Department shall be as established by the Village Board and amended from time to time in conformance with the requirements of the Wisconsin Public Service Commission. The fee schedule as established shall be on file as provided in § 223-1. The Village Board shall also determine the connection charges to be charged to developers under § 223-3B.

A. 
As provided in Wis. Stats. § 66.0805(6), the Village Board is in charge of the operations and management of the Village of Waterford Water Utility. The Water Utility shall function in accordance with the provisions of Wis. Stats. Chs. 196 and 197 and any and all applicable state or local laws or regulations pertaining to the operation of water utilities.
(1) 
Accounting. The Village Board shall establish a financial management system that accounts for all revenues and all expenditures relating to the water system. It shall keep separate detailed accounting of Water Utility funds and provide periodic accounting reports in order to meet the requirements of the Wisconsin Public Service Commission.
(2) 
Control of water mains, etc. The water mains, supply pipes, curb stops, stop boxes, meters, service pipes and other equipment of the Utility shall be under the exclusive control of the Village Board and its authorized agents and employees, and no other person shall disturb, tamper with, injure, tap, change, obstruct access to or interfere with such water mains, supply pipes, curb stops, stop boxes, meters, service pipes or other equipment.
B. 
Director of Public Works.
(1) 
Appointment. The Village Board shall appoint the Director of Public Works at such times as it deems necessary.
(2) 
Duties. The Director of Public Works shall:
(a) 
Perform all duties concerning the Village waterworks imposed upon him by the Village Board and shall see that all rules and regulations of the Board concerning the waterworks are carried out in addition to performing the duties of Director of Public Works.
(b) 
Watch over all machinery and everything connected therewith and see that no deprecations or misdemeanors are committed about the place or buildings connected with the waterworks system.
(c) 
Keep himself prepared for duty at all times.
(d) 
Have charge of the motor, pump and machine shop and the care and supervision of the running of the motor and all machinery connected therewith.[1]

(e) 
Monitor the quantity of water in the reservoirs and make necessary adjustments thereto.
(f) 
See that all valves and every part of the waterworks system is in running order and, in the case of breakage or defects in the same, shall give immediate notice to the Village Board or the Chairman of the Public Works and Utilities Committee.
(3) 
Compensation. The Director of Public Works shall receive such compensation as the Village Board shall from time to time determine.
(4) 
Bond. The Village Board may require a bond of the Director of Public Works before entering upon his duties for such sum as it may determine, conditioned for the faithful discharge of his duties.
C. 
Records. All records pertaining to the management of the Village waterworks, except those required to be kept by the Director of Public Works, shall be kept by the Utility Clerk in books provided for that purpose. Such records shall show the names of all patrons, descriptions of premises supplied, uses to which the supply of water is put, rate of tariff, collections made and such other matters as the Board may from time to time require to be recorded.

The rate rules and applicable charges shall be as set forth in the schedules approved by the PSC and adopted under § 223-1, as may be amended from time to time.

Land use and activities in the recharge area of Wells No. 3, 4 and No. 5 in the Village of Waterford shall be regulated for the purpose of protecting the groundwater pursuant to Village of Waterford Municipal Code Chapter 245, Zoning, § 245-25 and Article IX.

A. 
Purpose. The purpose of this section is to protect public health, safety and welfare and to prevent contamination of groundwater by assuring that unused, unsafe or noncomplying wells or wells which may act as conduits for contamination of groundwater or wells which may be illegally cross-connected to the municipal water system are properly maintained or abandoned.
B. 
Applicability. This section applies to all wells located on premises served by the Village of Waterford municipal water system. Utility customers outside the jurisdiction of the municipal system may be required under contract agreement or utility rule to adopt and enforce equivalent ordinances within their jurisdictions for purpose stated in Subsection A above.
C. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
MUNICIPAL WATER SYSTEM
The community water system owned by the Village of Waterford.
NONCOMPLYING
A well or pump installation that does not comply with Wis. Admin. Code Subch. IV, Standards for Existing Installations, and which has not been granted a variance pursuant to Wis. Admin. Code § NR 812.43.
PUMP INSTALLATION
The pump and related equipment used for withdrawing water from a well, including the discharge piping, the underground connections, pitless adapters, pressure tanks, pits, sampling faucets and well seals or caps.
"UNSAFE" WELL OR PUMP INSTALLATION
One which produces water which is bacteriologically contaminated or contaminated with substances which exceed the drinking water standards of Wis. Admin. Code Chs. NR 140 or 809, or for which a Health Advisory has been issued by the Department of Natural Resources.
"UNUSED" WELL OR PUMP INSTALLATION
One which is not used or does not have a functional pumping system.
WELL
A drillhole or other excavation or opening deeper than it is wide that extends more than 10 feet below the ground surface constructed for the purpose of obtaining groundwater.
WELL ABANDONMENT
The proper filling and sealing of a well according to the provisions of Wis. Admin. Code § NR 812.26.
D. 
Abandonment required. All wells on premises served by the municipal water system shall be properly abandoned in accordance with Subsection F no later than 180 days from the date of connection to the municipal water system, or the date of discovery or construction of the well, or the date of notice from the Village, unless a valid well operation permit has been issued to the well owner by the Village of Waterford under the terms of Subsection E.
E. 
Well operation permit.
(1) 
Owners of wells on premises served by the municipal water system wishing to retain their wells for any use shall make application for a well operation permit for each well no later than 180 days after connection to the municipal water system or the date of discovery or construction of the well, or the date of notice from the Village. The Village shall grant a permit to a well owner to operate a well for a period not to exceed five years providing all conditions of this section are met. A well operation permit may be renewed by submitting an application verifying that the conditions of this section are met. The applicant shall arrange for inspections and water quality tests to be conducted at the applicant's expense to obtain or verify information necessary for consideration of a permit application or renewal. Permit applications and renewals shall be made on forms provided by the Utility Clerk. All initial and renewal applications must be accompanied by a fee as adopted by the Village Board and set forth in the Fee Schedule.[1] No new wells or replacement wells are allowed.

(2) 
The following conditions must be met for issuance or renewal of a well operation permit:
(a) 
The well and pump installation shall meet the Standards for Existing Installations described in Wis. Admin. Code Subch. IV, § NR 812.42, Criteria for Evaluation. The well and pump system shall be evaluated by a licensed well driller or pump installer and certified on the Wisconsin Well and Pressure System Inspection Form 3300-221 to comply with Wis. Admin. Code Ch. NR 812, Subch. IV, prior to the issuance of the initial permit and every 10 years thereafter.
(b) 
The well and pump shall have a history of producing safe water evidenced by at least one coliform bacteria sample taken prior to the initial permit issuance and each permit renewal. In areas where the Department of Natural Resources has determined that groundwater aquifers are contaminated with substances other than bacteria, additional chemical tests may be required to document the safety of the water.
(c) 
There shall be no cross-connections between the well's pump installation or distribution piping and the municipal water system.
(d) 
The water from the private well shall not discharge into a drain leading directly to a public sewer utility unless properly metered and authorized by the sewer utility.
(e) 
The private well shall have a functional pumping system.
(f) 
The owner shall demonstrate a need for the use of the private well.
(g) 
Any well that does not meet the requirements for a permit shall be abandoned pursuant to Subsection F.
F. 
Abandonment procedures.
(1) 
All wells abandoned under the jurisdiction of this section shall be done according to the procedures and methods of Wis. Admin. Code § NR 812.26. All debris, pumps, piping, unsealed liners and any other obstructions which may interfere with sealing operations shall be removed prior to abandonment.
(2) 
The owner of the well, or the owner's agent, shall notify the Utility Clerk that the well will be abandoned.
(3) 
An abandonment report form, supplied by the Department of Natural Resources, shall be submitted to the Utility Clerk and the Department of Natural Resources within 30 days of the completion of the well abandonment. The form must be completed by the licensed well driller, pump installer, or certified operator performing the abandonment.
G. 
Violations and penalties.
(1) 
Any person who violates any provision of this section shall be subject to a penalty as provided in Chapter 1, Article II, of this Municipal Code.
(2) 
Each day in which a violation continues shall be deemed a separate offense.
(3) 
If any person fails to comply with this section for more than 30 days after receiving written notice of the violation, the Village may cause the well abandonment to be performed and the expense to be assessed as a special charge against the property as set forth in § 66.0627, Wis. Stats.
A. 
Filling. Upon the request of any real property owner, and provided a minimum of three days' notice therefor is given, the Village shall supply water for the filling of swimming pools in the corporate limits of the Village. The Utility shall supply such water during regular business hours only and only at such times as do not interfere with the other orderly operation of the Utility's business.

B. 
Meter. Prior to the supplying of such water, a meter shall be installed for the purpose of metering the water's delivery and a fee as set per § 223-7 shall be charged and collected for the meter installation prior to delivery.
C. 
Charges. The charge for this service shall be as set forth in § 223-7.

A. 
Authority to issue water conservation measures. The Village President is hereby authorized to issue an order establishing water usage restrictions for the purpose of conserving water, and in his or her absence the Director of Public Works or the Village Administrator may issue the order. The order shall establish the type (as described in Subsection C) and the duration of the water usage restrictions. The duration may be a specified period of time or may simply be "until further public notice."
B. 
Public notice of the restrictions. When a water usage restriction order is issued under Subsection A, public notice of said restriction shall be published in the local paper and on the Village web page, sent to local news stations, and posted in three public places in the Village of Waterford. The Village may use additional forms of notice it considers necessary under the circumstances.
C. 
Water use restrictions.
(1) 
Level 1 water use restrictions shall be as follows:
(a) 
Watering allowed using sprinklers or irrigation systems for even addresses on even dates and for odd addresses on odd dates between the hours of 7:00 p.m. and 7:00 a.m. Irrigation systems that encompass both an even and odd address shall operate every other day. The odd-even dates will begin at 7:00 p.m. and carry through to 7:00 a.m. the following morning.
(b) 
Watering allowed of trees, shrubs and other outside plants when using a handheld device such as a sprinkling can or hose with sprayer (when handheld) on any day at any time.
(c) 
Watering allowed on newly seeded lawns or lawns with newly installed sod any day between the hours of 7:00 p.m. and 7:00 a.m.
(d) 
The use of children's water toys will be allowed only when attended by at least one person.
(e) 
Washing of vehicles and trailers is allowed for even addresses on even dates and for odd addresses on odd dates only.
(f) 
No watering of hard surfaces (i.e., streets, sidewalks, and driveways) that is a result of poorly placed and/or maintained sprinklers or an unattended hose.
(g) 
No watering during precipitation.
(2) 
Level II water use restrictions shall be as follows:
(a) 
No watering allowed using sprinklers or irrigation systems.
(b) 
Watering allowed of trees, shrubs and other outside plants only when using a handheld device such as a sprinkling can or hose with sprayer (when handheld) on any day at any time.
(c) 
Watering allowed on newly seeded lawns or lawns with newly installed sod only by issuance of a fifteen-day permit issued by the Village's Director of Public Works or his or her designee.
(d) 
Watering allowed for businesses that sell plants for a living by issuance of a fifteen-day permit issued by the Village's Director of Public Works or his or her designee.
(e) 
No use of children's water toys will be allowed.
(f) 
No washing of vehicles or trailers.
(g) 
No watering of hard surfaces (i.e., streets, sidewalks, and driveways) that is a result of an unattended hose.
(h) 
No watering during precipitation.
(i) 
Request voluntary reduction of water usage by higher-volume commercial business users.
(3) 
Level III water use restrictions:
(a) 
No outside water use allowed.
(b) 
Limit indoor water use where possible.
(c) 
Require reduction of water usage by higher-volume commercial business users, including but not limited to carwashes, laundromats and factories. These businesses would be evaluated on an individual basis and operate under the issuance of a fifteen-day permit issued by the Village's Director of Public Works or his or her designee.
D. 
Emergencies. Whenever, in the opinion of the Village Board, a necessity to limit water exists due to weather conditions, water usage, electrical power outage or any other cause, the Village Board may, for such time as the necessity for water limitations exist, issue orders and regulations, suspend permits, alter days and hours, impose additional terms and conditions, and prevent usage of water.
E. 
Enforcement. This section may be enforced by the issuance of citations or by any other method authorized by law.
F. 
Violations and penalties. Any person who violates any provisions of this section shall be subject to penalty as set forth in § 223-31.
