For the purpose of promoting the health, safety, morals and
the general welfare of the community, the Village of Clayton is hereby
zoned into the following zoning districts:
A. Single-Family Residential (SFR). Purpose: to provide for the development
of residential neighborhoods occupied primarily by year-round single
families.
B. Neighborhood Residential (NR). Purpose: to provide for the development
of residential neighborhoods occupied by differing types of residential
structures, together with certain additional uses which are supporting
to and compatible with residential neighborhoods. It is contemplated
that all residences in these districts shall be served by public water
supply and public sewage disposal facilities.
C. Neighborhood Residential - Special Use (NR-SU). Purpose: to provide
for the development of residential neighborhoods south of State Street
occupied by differing types of residential structures, together with
certain additional special uses which are supporting to and compatible
with residential neighborhoods.
D. General Residential (GR). Purpose: to provide for a variety of residential
development options and for appropriate commercial development.
E. Marine Development (MD). Purpose: to provide areas for water-related
resort activity along with specified commercial recreation activities
normally associated with such areas and residential development in
compliance with the LWRP.
F. Business (B). Purpose: to provide districts to accommodate general
retail, service, finance and real estate and related structures and
uses. It is contemplated that these districts will be established
only in areas served by public water supply and public sewage disposal
facilities.
G. Riverwalk District - A (RW-A). Purpose: It is the purpose of this
district to allow for the protection of existing single-family residences
while allowing for development and redevelopment of water-dependent
and water-enhanced commercial projects by evaluating each project
following the Village Comprehensive Plan, Village Zoning Law, and
the policies and provisions of the Village's Local Waterfront
Revitalization Program (LWRP).
H. Riverwalk District - B (RW-B). Purpose: to encourage the development
and/or expansion of water-dependent and water-enhanced uses on the
street level and commercial uses on the upper floors. Residential
uses in multistory buildings are limited to above street level. Each
project will be evaluated following the Village Comprehensive Plan,
Village Zoning Law, and the policies and provisions of the Village's
Local Waterfront Revitalization Program (LWRP).
I. Riverwalk District - C (RW-C). Purpose: to encourage resort development
such as hotels, townhouses, small commercial enterprises, and related
docking and marina facilities; to allow for development in a unique
waterfront location, each project will be evaluated for compatibility
with the policies and provisions of the Village's Local Waterfront
Revitalization Program (LWRP), Village Comprehensive Plan, and Village
Zoning Law.
J. Industrial (IND). Purpose: to provide for general industrial use
and development.
K. Industrial - A (IND-A). Purpose: to provide for small manufacturing
operations and adult entertainment.
The boundaries of the above-named zoning districts are as shown
on a map entitled "Zoning Map, Village of Clayton," adopted March
6, 2009, amended May 11, 2015, and certified by the Village Clerk,
which accompanies and which, with all explanatory matter thereon,
is hereby made a part of this chapter.
Where uncertainty exists with respect to the exact boundaries
of districts as shown on the Zoning Map, the following rules shall
apply:
A. Boundaries shown as approximately following the center line of streets
or highways shall be construed to follow such center lines.
B. Boundaries shown as approximately following lot lines shall be construed
to follow such lot lines.
C. Boundaries shown as following the shoreline of the St. Lawrence River
and its tributaries shall be construed to follow such shoreline at
the high water mark.
D. Boundaries shown as following shorelines of other streams, lakes
and reservoirs shall be construed to follow such shorelines and to
move with changes in the actual shorelines.
E. Boundaries indicated as parallel to or extensions of features, i.e., streets, lot lines, high water mark, indicated in Subsections
A through
D, above, shall be construed to be parallel to or extensions of such features.
F. Distances not specifically set forth in the Zoning Map shall be determined
by the scale of the map.
