(a) Required. No person shall place any object which encroaches over
or temporarily blocks off any portion of the public right-of-way unless
he has applied for and secured a permit to do so issued by the Town
Manager or the Town Manager's designee. The fee for each such
permit shall be established by Council and published in the Windsor
Price Guide including an additional charge per square foot per day
for each square foot occupied within the public right-of-way. Fences,
guiderail, and structures built within the Town right-of-way which
are permanent or semi-permanent in nature, will only require a permit
fee.
(b) Application. An application for the permit required by this section
shall be signed by the owner or his authorized agent. The permit shall
specify the exact nature, time and location of the obstruction or
encroachment and shall contain an agreement to be signed by the applicant
that the contemplated work will be done in accordance with the rules
and regulations of the department of public works and that he will
indemnify and save the Town harmless from all damages caused by his
acts or omissions while acting under the permit.
(c) Posting on work site. The permit required for all temporary obstructions
shall be kept on the site during the continuance of the work and a
permit notice shall be posted in a conspicuous place on the job.

The enactment of this ordinance (Ordinance No. 91-2) repealing
specific sections of the prior ordinance as existing shall not operate
as an abatement of any action of proceeding thereon now pending under
or by the authority of said prior ordinance. All of said actions and
proceedings are hereby ratified to be continued.

All provisions of the Town Code in conflict herewith are hereby
repealed, and if for any reason any word, clause, paragraph, or section
of Ordinance No. 91-2 shall be held to make the same unconstitutional,
such ordinance shall not hereby be invalidated and the remainder of
the ordinance shall continue in effect. Any provision herein which
is in conflict with the Connecticut General Statutes is hereby repealed,
it being understood that said statutes shall take precedence over
this ordinance.

Ordinance No. 91-2 shall become effective 10 days after publication
in a newspaper having a circulation in Windsor.
