A. Scope of service.
(1) Municipal curbside collection shall be provided to all residential
properties and small businesses currently receiving service. Municipal
curbside collection for nonresidential properties shall not be provided.
(2) Residential properties on private ways that are not eligible for
municipal curbside collection shall bring their rubbish and recyclables
to the nearest public way on their scheduled collection day.
B. Scheduling of collections. The scheduling of municipal curbside collection
or special collections shall be established by the City Manager. The
City Manager shall also, from time to time, schedule special drop-offs.
C. Supervision of collections. The Public Works Director shall be responsible
for municipal curbside collection and the collection of solid waste
within the City.
D. Preparation for collection.
(1) General.
(a)
Only rubbish and recyclables which are generated in Augusta
and from the property that is receiving municipal curbside collection
shall be placed curbside for collection.
(b)
Municipal employees are hereby prohibited from entering upon
private property for the purpose of municipal curbside collection.
Municipal employees may enter upon an eligible private way for the
purposes of performing municipal curbside collection.
(2) Container specifications.
(a)
Rubbish shall be placed in solid, whole plastic bags of adequate
strength that are tied or sealed securely with a minimum of two cubic
feet (thirteen gallon) capacity. Plastic bags stored outside a structure
prior to 6:00 a.m. on the day of collection shall be placed in metal
cans or rigid plastic containers with covers, with a minimum height
of 20 inches and a maximum height of 30 inches and a maximum diameter
of 20 inches.
(b)
Bags or containers shall not exceed a gross weight of 30 pounds.
(c)
The City is not responsible for the loss of or damage to metal
or plastic containers.
E. Location of containers; time for setting out; responsibility for
clean-up.
(1) Rubbish/recyclable containers and solid waste for special collections
shall be placed curbside on an eligible private way or on City property
immediately adjacent to the property owned, rented or leased by the
person or persons placing the containers. It shall be unlawful to
place containers of rubbish/recyclables and solid waste on the property
of another without the consent of the property owner or on City property
other than as provided for in this subsection. During the winter months,
containers shall be placed as near to driveways or walkway openings
as possible.
(2) Rubbish/recyclable containers and solid waste for special collections
may not be set out for collection prior to 4:00 p.m. on the day before
the scheduled collection. Containers must be at the curb prior to
7:00 a.m. on the scheduled collection day and shall be removed from
the curbside no later than 9:00 p.m. on the day of collection.
(3) The City may not collect rubbish/recyclables that are not properly
contained at the time of collection. Clean-up of rubbish/recyclables
which are not properly contained at time of collection shall be the
responsibility of the property owner or tenant.
F. Special collections/drop-offs.
(1) Cardboard boxes broken down and securely tied in bundles not exceeding
15 cartons or weight in excess of 30 pounds will be accepted for municipal
curbside collection.
(2) The City offers a voluntary recycling program. Augusta residents
who wish to participate in the voluntary program shall prepare recyclables
in accordance with the requirements of the City's recycling vendor.
The materials preparation specification sheet shall be revised as
necessary.
(3) The City Manager may designate special clean-up weeks for accumulations
of household waste, property debris, and other debris as specified
in the "clean-up" specification sheet provided by the Public Works
Department. Such collection shall provide for collection of items
not acceptable for regular weekly collections. Each clean-up week
shall be on a fee system established annually by the City Manager.
(4) The City may offer special drop-off programs, including, but not limited to, leaves, Christmas trees and recyclables. Drop-off points and times shall be designated in accordance with Subsection
B.

A. Public Works authority. The Public Works Director shall adopt a policy
in accordance with this section by which the City may perform municipal
curbside collection on eligible private ways within Augusta.
B. Eligibility criteria. The policy adopted by the Public Works Director
shall set forth criteria which any private way requesting municipal
curbside collection must satisfy to receive municipal curbside collection.
The policy must include the following eligibility criteria:
(1)
Minimum residences. The private way must serve at least three
residences.
(2)
Adequate construction. The private way must be constructed and
maintained in a manner sufficient to ensure the safe operation and
passage of City equipment and personnel as determined by the Public
Works Director in consultation with the City Engineer.
(3)
Road association or designated spokesperson. The private way
must have a road association or designated spokesperson. The Public
Works Department shall be provided with contact information, including
an email address and phone number, for a road association member or
designated spokesperson. On private ways with more than 10 residences,
contact information for a second road association member or spokesperson.
(4)
Indemnification and waiver of claims. The road association of
the private way or all property owners with a fee interest in property
served by the private way must execute an indemnification and waiver
agreement agreeing to hold the City, its officials, employees, and
agents harmless for any damage to person or property resulting from
the performance of municipal curbside collection on the private way.
C. Application. The road association or other representative of a private
way may submit a written application for municipal curbside collection
to the Public Works Director for review. The application must contain
information and documentation sufficient to demonstrate compliance
with all eligibility criteria set forth in this section and in the
policy adopted by the Public Works Director except that the application
need not include an executed indemnification and waiver agreement.
D. Review of application. Within 30 days of receipt of an application
for municipal curbside collection, the Public Works Director shall
notify the requesting road association or representative that the
private way is ineligible for municipal curbside collection or is
preliminarily eligible for municipal curbside collection. If a private
way is determined to be preliminarily eligible for municipal curbside
collection, it shall submit an executed indemnification and waiver
agreement and any additional documentation requested by the Public
Works Director for review by Corporation Counsel. Upon written approval
of the indemnification and waiver agreement from Corporation Counsel,
the Public Works Director shall determine the private way is eligible
to receive municipal curbside collection.
E. Revocation of eligibility. The Public Works Director shall at least
annually inspect all eligible private ways for continued compliance
with the eligibility criteria set forth in this section and in the
policy adopted by the Public Works Director. If an eligible private
way is not adequately maintained or otherwise fails to satisfy the
eligibility criteria, the Public Works Director may temporarily suspend
or permanently cease municipal curbside collection on the eligible
private way. The Public Works Director shall provide at least 15 days'
notice of the suspension or termination of municipal curbside collection,
except where the condition of the eligible private way renders it
unsafe or impassable by City equipment or personnel.
F. Existing public easements. No provision of this section shall be
deemed to modify, affect or interfere with municipal curbside collection
on private ways over which the City was previously granted a public
easement for provision of those services.
