Upon the evidence given at the public hearing held May 31, 1995,
and continued on June 29, 1995, it is hereby found and determined
as follows:
A. The notices of the aforesaid public hearing and of said recessed
public hearing were published, posted and mailed as required by law,
and that they are otherwise sufficient.
B. All the property and property owners within said proposed Joint Fire
District are benefited thereby.
C. All the property and property owners benefited are included within
the boundaries of said proposed Joint Fire District.
D. The establishment of said proposed Joint Fire District is in the
public interest.
E. The actions proposed and the creation of said Joint Fire District
will not have an adverse impact on the environment as determined hereinbefore
by the negative declaration issued by the Town Board of the Town of
Livonia on behalf of itself and the Village Board of Trustees of the
Village of Livonia.
The Joint Fire District shall be bounded and described as follows:

The Town Clerk shall, within 10 days after the adoption of this
article, file a certified copy of such article in the office of the
Clerk of the County of Livingston and shall within said period file
a certified copy of the same with the New York State Comptroller by
filing the same in the office of the State Department of Audit and
Control at Albany, New York, together with such other papers and documents
as may be required by said Department, all in accordance with the
provisions of Town Law § 189-a.
This article is adopted subject to the permissive referendum
in Articles 7 and 11-a of the Town Law and in Articles 9 and 22-A
of the Village Law.
The Joint Fire District established by this article shall be
known as the "Livonia Joint Fire District."
The Livonia Joint Fire District shall be administered by five
members of the Board of Fire Commissioners who shall be appointed
by said Town Board and said Village Board of Trustees pursuant to
applicable law, including Town Law § 189-e and § 22-2210
of the Village Law.

Fire Protection District No. 3 of the Town of Livonia, Livingston
County, New York, heretofore established by it through the adoption
of a resolution in 1934, is hereby dissolved pursuant to Article 11–a
of the Town Law of the State of New York with all contracts for fire
protection entered into with the Lakeville and Hemlock Fire Districts
having been terminated, and any payments thereunder having already
been made to and received by said fire districts.
Hereafter, the Livonia Joint Fire District, created from the
major portion of said Fire Protection District No. 3, the Hemlock
Fire District and the Lakeville Fire District, as said fire districts
were extended by the addition to each of the remaining portions of
said Fire Protection District No. 3 are and will provide the regulatory
framework for the governing of and the prevention of fire and the
safeguarding of human life and property from fire in the area of said
former Fire Prevention District No. 3 of the Town of Livonia, Livingston
County, New York.
