This chapter shall be known as "The Land Development Code of
the Borough of Palmyra," referred to in this chapter in the short
form as "this code."
This code is adopted pursuant to N.J.S.A. 40:55D-1 et seq.,
in order to promote and protect the public health, safety, morals
and general welfare, and in the furtherance of the following related
and more specific objectives:
A. To secure safety from fire, flood, panic, and other natural and man-made
disasters.
B. To provide adequate light, air and open space.
C. To ensure that the development of the Borough does not conflict with
the development and general welfare of neighboring municipalities,
the county, and the state as a whole.
D. To promote the establishment of appropriate, population densities
and concentrations that will contribute to the well being of persons,
neighborhoods, communities, and regions and preservation of the environment.
E. To encourage an appropriate and efficient expenditure of public funds
by the coordination of public development with land use policies.
F. To provide sufficient space in appropriate locations for a variety
of residential, recreational, commercial, and industrial uses, and
open space, both public and private, according to their respective
environmental requirements in order to meet the needs of all New Jersey
citizens.
G. To encourage the location and design of transportation routes which
will promote the free flow of traffic while discouraging location
of such facilities and routes which would result in congestion or
blight.
H. To promote a desirable visual environment through creative development
techniques and good civic design and arrangements.
I. To promote the conservation of open space and valuable natural resources
and to prevent urban sprawl and degradation of the environment through
improper use of land.
J. To encourage coordination of the various public and private procedures
and activities shaping land development with a view of lessening the
cost of such development and to the more efficient use of land.
K. To promote the conservation of energy through the use of planning
practices designed to reduce energy consumption and to provide for
maximum utilization of renewable energy sources.
L. To regulate the location of buildings and establish standards of
development; to establish building lines and the location of buildings
designed for residential, commercial, office or other uses within
such lines and to fix reasonable standards to which buildings or structures
shall conform.
M. To prohibit incompatible uses; to prohibit uses, building or structures
which are incompatible with the character of development of the permitted
uses within specified zoning districts and surrounding area.
N. To promote the conservation of historic sites and districts.
O. To regulate alterations of existing buildings; to prevent such additions
to, and alterations or remodeling of, existing buildings or structures
as would not comply with the restrictions and limitations imposed
hereunder.
P. To conserve the value of land and buildings throughout the Borough.
Q. Within the community's resources, to meet the future housing needs
of the citizens of the Borough and the region and to assure a full
range of housing types to meet all income levels.
The purpose of this code is to consolidate the zoning regulations
and achieve substantial conformity with the primary elements of the
Master Plan of the Borough of Palmyra and to make such regulations
substantially consistent with the land use element of the Master Plan.
The intent of this code is to define the zoning regulations
for, but not limited to, the use of land and structures, area of lots,
bulk of buildings and other structures, the provision of on- and off-street
parking, accessory uses, permitted uses, fences, signs and similar
regulations for the Borough of Palmyra, Burlington County, New Jersey,
in accordance with the provisions of the New Jersey Municipal Land
Use Law (N.J.S.A. 40:55D et seq.) and to prescribe penalties for violation
of the provisions of this code.
All applicable requirements shall be met at the first time of
erection, enlargement, alteration, moving or change in use of a structure
and shall apply to the entire structure or structures, whether or
not the entire structure or structures were involved in the erection,
enlargement, alteration, moving or change in use.
The provisions of this code shall be held to be minimum requirements.
Where this code imposes a greater restriction than is imposed and
required by other provisions of law or by other rules, regulations
or resolutions, the provisions of this code shall control. Where other
laws, rules, regulations or resolutions require greater restrictions
than are imposed by this code, the provisions of such other laws,
rules, regulation or restrictions shall control.
All uses not expressly permitted in this code are prohibited.
