Any person seeking permission to conduct catered activities or operations
at the Catering Hall at Lake Lenape East Park shall execute and be
subject to a special license and indemnification agreement, which
shall include conditions, limitations, fees and insurance requirements.
Any person who has entered into a license and indemnification agreement
to conduct catered activities or operations at the Catering Hall at
Lake Lenape East Park may seek permission to serve alcoholic beverages
in connection with catered functions, subject to the following:
Made by the sponsoring entity that is duly authorized, as defined
by the NJABC, and is able to perform the tasks and requirements necessary
to conduct the proposed event.
Accompanied by a valid NJABC permit, or if a permit has not
been issued at the time of application to the County, then a copy
of the sponsoring entity's application to the NJABC for a permit.
There shall be no sale, storage, distribution, provision or use of
alcoholic beverages at any location within County park property unless
and until an NJABC permit has been obtained and provided to the County
Parks Director.
Accompanied by a written narrative that shall describe the details
of the event, including but not limited to a list of vendors, procedures
for event setup, parking, crowd control, any temporary fencing, event
security, ambulance/emergency response, procedures to ensure that
minors and intoxicated persons are not served alcohol, trash control,
post-event clean up and restoration of any damage to County property.
Accompanied by the name, address and contact information for
the person(s) who shall be responsible for implementation of the event.
Such persons shall be available to the County Parks Director and County
Rangers at all times during the event.
The application and supporting information listed above shall be
submitted simultaneously to the County Parks Director in accordance
with any proposal to engage in catering operations and to the Atlantic
County Board of County Commissioners, with a request for a resolution
authorizing the required license and indemnification agreement. The
County Parks Director shall not take action upon the application and
no operations shall occur until after a resolution authorizing the
required license and indemnification has been adopted by the Board
of County Commissioners and such agreement has been fully executed.
The sponsoring entity shall procure a liquor liability policy with limits of not less than $2 million or such greater amount as may be recommended by the County's Risk Manager/Consultant, which policy shall name the County of Atlantic and the State of New Jersey as additional insureds. The policy and the certificate of insurance shall be in a form as approved by the County's Risk Manager. These provisions shall not affect the insurance provisions which are specified in § 97-52B.
The sponsoring entity shall be solely responsible for conducting
the event in accordance with all applicable laws and ordinances in
a manner that shall not cause damage to persons or property. The County
shall not assume responsibility for the conduct and/or supervision
of the event.
The sponsoring entity shall be responsible for preventing service
of alcohol to any person who is under the legal age to consume alcoholic
beverages in the State of New Jersey.
The sponsoring entity shall be responsible for preventing service
of alcohol to any person who is visibly intoxicated or under the influence
of alcohol or other intoxicants or stimulants.
A permit shall not be effective and the proposed event shall not
be permitted to occur if all of the requirements set forth in his
section have not been deemed satisfied by the County Parks Director.
The permittee shall be responsible for ensuring that any permit or
inspection requirements administered by the Atlantic County Division
of Public Health that apply to food service are satisfied.
Noise; music. The permittee shall take measures necessary to ensure
that noise emanating from its catered events, including but not limited
to music and other amusements, announcements and activities shall
comply with the following:
There shall be no music or other loud noise which shall disturb the
peace and enjoyment of neighboring properties or other park users.
Music or other noise shall be deemed a violation of this section as
follows:
No person shall cause to be made, directly or indirectly, any
noise emanating from the recreational area between the hours of 10:00
p.m. and 6:00 a.m., prevailing time, which is plainly audible at a
distance of 50 feet from the source of the noise.
Penalties. In addition to any other sanction or remedy provided in
this section or in any license and indemnification agreement, if the
County Parks Director determines that a catered event is not being
conducted in compliance with the requirements of this chapter, the
County Parks Director shall be authorized to immediately suspend the
permittee's license and permit to conduct operations, in which event
the permittee shall be responsible for immediately directing and causing
all of its guests, invitees and other persons attending such event
to leave the County's premises in a peaceable and orderly manner.
