This chapter shall be known as and may be cited as the "Spring
Grove Borough Manager Ordinance."
The purpose of this chapter is to enable the Borough to function
under generally accepted principles of the Council-Manager form of
government. The Borough Council shall be responsible for supervising
and conducting the administrative affairs of the Borough in a nonpartisan
manner. It is the intent of this chapter to delegate to the Borough
Manager all of the nonlegislative and nonjudicial powers and duties
of the Council as authorized by Section 1141 of the Borough Code.
The position of Borough Manager is hereby created. The Manager
shall be appointed for an indefinite term by a majority of all the
members of the Borough Council which fix the hours and amount of compensation
from time to time as may be deemed necessary.
The Borough Manager shall be chosen solely on the basis of the
executive and administrative qualifications, with special reference
to training and experience in municipal government.
Whenever in this chapter a masculine pronoun is used, it includes
the feminine.
Before entering upon his duties, the Manager shall give a bond
to the Borough with a bonding company as surety, to be approved by
the Council, in the sum of $30,000, conditioned upon the faithful
performance of his duties, the premium for said bond to be paid by
the Borough.
The Borough Manager shall be the chief administrative officer
of the Borough and shall:
A. Be responsible to the Borough Council for carrying out all policies
and programs established by the Council.
B. Direct and supervise the administration of all departments and functions
of the Borough except as otherwise provided by ordinance or law.
C. Appoint and, when deemed necessary, suspend, remove or otherwise
discipline on the basis of merit system principles, subject to ratification
from Borough Council. This subsection shall not apply to the Borough
Solicitor and the Borough Engineer.
D. Make such recommendations to the Council concerning policy formulation
as deemed desirable.
E. Prepare and submit the annual budget to the Council, together with
such explanatory comment as deemed desirable; and administer the approved
budget.
F. Keep the Council and public informed as to the conduct of Borough
affairs.
G. Under the direction of the Mayor, execute and enforce the laws of
the commonwealth and ordinances and resolutions of the Borough, which
authority shall include supervision of the Police Department.
H. Prepare the agenda and attend all meetings of Council with the right
to take part in the discussion but not to vote.
I. Hold such other municipal offices and head such municipal departments
as the Borough Council may from time to time direct.
J. Attend to the letting of contracts in due form of law, and supervise
the performance and faithful execution of the same, except insofar
as such duties are expressly imposed by statute upon some other Borough
officer.
K. Negotiate and sign contracts for the Borough subject to approval
by the Council.
L. Oversee payment of all money owed the Borough; and assure that proper
proceedings are taken for the security and collection of all the Borough's
claims.
M. Attend all meetings of the Council, Planning Commission and Zoning
Hearing Board and attend meetings of committees as required and take
part in the discussions. The Manager shall receive notice of any special
meetings of the Council and committees.
N. Prepare the agenda for each meeting of the Council, Planning Commission
and the Zoning Hearing Board and supply facts pertinent thereto.
O. Ensure that the minutes of the meeting of the Council, Planning Commission
and, if required, the Zoning Hearing Board are prepared.
P. Employ, by and with the approval of the Council, experts and consultants
to perform work and to advise in connection with any of the functions
of the Borough.
Q. Be the purchasing officer of the Borough and purchase, in accordance
with the provisions of the Borough Code, all supplies and equipment for the agencies, boards, departments
and other offices of the Borough, provided that all capital expenditures
shall be subject to prior approval of the Borough Council. He shall
keep an account of all purchases and shall, from time to time or when
directed by the Borough Council, make a full written report thereof.
He shall also issue rules and regulations, subject to the approval
of the Borough Council, governing the procurement of all municipal
supplies and equipment.
R. All complaints regarding Borough services shall be referred to the
office of the Manager. He, or an officer designated by him, shall
investigate and dispose of such complaints, and the Manager shall
report thereon to the Borough Council. He shall cooperate with the
Borough Council at all times and in all matters that the best interests
of the Borough and of the general public may be maintained.
S. Research and investigate the administrative and governmental functions
of various boroughs and townships and make a recommendations to the
Council of appropriate ordinances affecting the health, safety, welfare
and administration of this Borough. He shall establish and maintain
appropriate filing systems and efficient administrative procedures
for the conduct of the business of the Borough.
T. Perform the duties of Borough Secretary and Treasurer.
U. Perform such other duties as are designated by the Council.
The Borough Manager shall abide by the Pennsylvania Public Official
and Employee Ethics Law.
The Borough Council shall act as a body in its dealings with
the Manager. Individual Council members may contact the Manager or
any subordinate of the Manager for information, but a Council member
shall not interfere with the Manager or any subordinates in the performance
of their duties. The Council may, however, establish a temporary committee
of its own members to review the operations of the Borough departments.
If the Manager becomes ill or needs to be absent from the Borough,
the President of Council shall serve in his place.
With approval of the Borough Council, the Mayor may delegate
to the Borough Manager any of his nonlegislative powers and duties.
