As used in this chapter, the following terms shall have the
meanings indicated:
All products made of aluminum, including aluminum cans, foil,
wrappers, containers for prepared dinners or other foods, screen frames
and lawn chairs.
The placement of yard waste in a trash can, bucket, bag or
other container, such as to prevent the yard waste from spilling or
blowing out into the street and coming into contact with stormwater.
All products made from silica or sand, soda ash and limestone,
the product being transparent or translucent and being used for packaging
or bottling of various matter, and all other material commonly known
as "glass," excluding, however, blue and flat glass and glass commonly
known as "window glass."
All products made of metal, exclusive of aluminum, including
washers, dryers, refrigerators, stoves, hot-water heaters, tire rims,
springs, bicycles, bimetal cans (tin cans) or scrap metal.
Oil commonly used in automobiles, motor-driven vehicles and
combustion engines.
Any individual, corporation, company, partnership, association,
or political subdivision of this state subject to municipal jurisdiction.
Any recyclable materials made of metal, glass, plastic, cardboard,
used newspaper, or wastepaper products.
Any street, avenue, boulevard, road, parkway, viaduct, drive,
or other way, which is an existing state, county, or municipal roadway,
and includes the land between the street lines, whether improved or
unimproved, and may comprise pavement, shoulders, gutters, curbs,
sidewalks, parking areas, and other areas within the street lines.
Includes paper of the type commonly referred to as "newsprint"
and distributed at stated intervals, usually daily or weekly, having
printed therein news and opinions and containing advertisements and
other matters of public interest.
All uncontaminated paper material, such as magazines, books,
papers, food cartons, cardboard boxes, wrapping paper, bags and discarded
letters and envelopes.
Leaves, brush, roots, weeds, grass clippings, logs, stumps,
vegetative waste, and Christmas trees.
A.
The Borough shall collect the recyclables listed in § 233-2 of this chapter from residential and commercial premises. All persons occupying residential and commercial premises shall separate recyclables from solid waste (as defined in Chapter 261 of the Borough Code) and shall arrange for the disposal and removal of said recyclables in accordance with this section. Recyclables shall be placed for curbside collection after 5:00 p.m. on the night prior to the scheduled pick-up date, or before 6:00 a.m. on the scheduled pickup date.
B.
All recyclables shall be placed in labeled recycling containers or
paper bags, in accordance with this section. Recyclables shall be
placed at the curb, no less than two feet away from solid waste.
C.
When not placed at the curb in accordance with this chapter, all labeled recycling containers, bags, or any other receptacles containing recyclables shall not be placed in an area that is visible from the street. Labeled recycling containers, bags, and other receptacles containing recyclables shall be stored in the rear yard or the side yard of residential and commercial properties. For purposes of this chapter, the area(s) comprising the rear yard or the side yard shall be in accordance with § 141-4 of the Borough Code.
D.
All recyclables will be commingled in a labeled recycling container.
E.
Recyclables shall be washed as clean as possible, and shall have
all lids and caps removed.
F.
Only plastics marked as No. 1 (PETE), No. 2 (HDPE), No. 4 (LDPE),
No. 5 (PP), and No. 7 (other; containing resin) shall be placed into
a labeled recycling container. Plastic should be crushed before being
placed into a recycling container. The placement of plastic bags and
plastic caps into any recycling container is prohibited.
G.
Cardboard boxes shall be flattened prior to placement into a recycling
container. Flattened cardboard boxes shall not be bundled or tied
together any larger than 18 inches by three feet, or in a manner weighing
more than 50 pounds.
H.
Used newspaper, magazines, mixed paper, cardboard and pizza boxes,
and junk mail may be placed into a labeled recycling container with
other permissible recyclables. Any used newspaper, magazines, mixed
paper, or junk mail that is not placed in a labeled recycling container
shall be bundled and tied, or placed into paper bags.
From the time of placement at the curb or at any place designated
by regulation by any one of the categories described herein for collection
by the Borough of Collingswood in accordance with the terms hereof,
items shall be and become the property of the Borough of Collingswood
or its authorized agent. It shall be a violation of this chapter for
any person unauthorized by the Borough of Collingswood to collect
or pick up or cause to be collected or picked up any such items, including
recycling buckets. Any and each such collection in violation hereof
from one or more residences shall constitute a separate and distinct
offense punishable as hereinafter provided.
A.
The Borough shall collect yard waste from residential and commercial premises. All persons occupying residential and commercial premises shall separate yard waste from solid waste (as defined in Chapter 261 of the Borough Code) and shall arrange for the disposal and removal of said yard waste in accordance with this section, unless yard waste is stored or recycled for the purpose of composting.
B.
Yard waste over four inches in diameter (large brush) shall be placed
at the curb and will be picked up by the Borough Public Works Department.
Residents must contact the Borough Public Works Department to arrange
for the removal of large brush.
C.
Yard waste that is less than four inches in diameter (small brush)
shall be placed loose in cans or tied in bundles, between May 1 and
September 30 of any given calendar year. Small brush shall not be
placed in plastic bags and will not be accepted by the Borough. The
placement of small brush into plastic bags shall be a violation of
this chapter.
D.
Grass shall be placed in containers with no lids. Grass shall not
be placed in plastic bags and will not be accepted by the Borough.
The placement of grass into plastic bags shall be a violation of this
chapter.
E.
Leaves shall be collected by the Borough between October and December
in any given calendar year. Advanced notice of said collections will
be provided by the Borough.
F.
Christmas trees will be collected by the Borough Public Works Department.
Christmas trees shall be placed at the curb for collection on the
regularly scheduled trash collection date.
G.
The owner or occupant of any property, or any employee or contractor
of such owner or occupant engaged to provide lawn care or landscaping
services, shall not sweep, rake, blow or otherwise place yard waste
in the street. If yard waste that is not containerized is placed in
the street, the party responsible for placement of yard waste must
remove the yard waste from the street or said party shall be deemed
in violation of this chapter.
H.
Sweeping, raking, blowing or otherwise placing yard waste that is
not containerized at the curb or along the street is only allowed
during the seven days prior to a scheduled announced collection and
shall not be placed closer than 10 feet from any storm drain inlet.
Placement of such yard waste at the curb or along the street at any
other time or in any other manner is a violation of this chapter.
If such placement of yard waste occurs, the party responsible for
placement of the yard waste must remove the yard waste from the street
or said party shall be deemed in violation of this chapter.
It shall be a violation of this chapter for any person to place
motor oil in any containers used for recyclables or yard waste, or
to otherwise comingle motor oil with recyclables or yard waste. Residents
must bring motor oil in a sealed and labeled container to the Borough
Garage, located at 713 North Atlantic Avenue, between 7:00 a.m. and
3:00 p.m., Monday thru Friday.
Any person who violates or neglects to comply with any provisions
of this chapter or any regulation promulgated pursuant thereto shall,
upon conviction thereof, be punished by a fine not to exceed $500
for the first offense, imprisonment for not more than 90 days or a
period of community service for not more than 90 days, or any combination
thereof.
This chapter shall be enforced by the Police Department, Public
Works Department, and the Nuisance Officer of the Borough of Collingswood.
