It is the intent of the Town Council of the Town of Southington
to regulate the location where tobacco and nicotine products or delivery
products (e.g., potential paraphernalia) can be sold within businesses
that sell such items. Further, it is the intent of this article to
place those items in specific areas of the store to prevent undue
influence onto minors. And further, it is the intent of the Town Council
of the Town of Southington to prohibit the sale of tobacco products
or nicotine products, delivery products and smoking devices to minors.
As used in this article, the following terms shall have the
meanings indicated:
An establishment located in the Town of Southington either
operated by a sole proprietor or a business structure recognized by
the State of Connecticut.
The area for which a customer is waiting prior to checking
out, customarily located in a convenience store.
The area for which a customer is waiting prior to checking
out, customarily located in a grocery or department store.
A person under the age of 18 years.[1]
A.
No person or business shall allow the placement for sale of any tobacco
or nicotine products or delivery products and smoking devices (e.g.,
potential paraphernalia), including but not limited to electronic
cigarettes, pipes, bongs, hookah, and rolling paper, at any location
with public access. They shall be behind any checkout counter or customer
service counter.

B.
Along with the regulations for sale of tobacco products, all tobacco
delivery products and any smoking devices shall be both locked and
placed behind the counter to prevent undue influence onto minors.
Whoever violates the provisions of this article may be issued
a violation by the Southington Police Department.
A.
Each violation of this article shall be considered a separate municipal
offense.
B.
Each day any violation continues shall constitute a separate offense.
C.
Each separate offense under this article shall be punishable by a
fine of the maximum amount allowed by Connecticut General Statutes
payable to the Town of Southington.
