It shall be unlawful for any person, firm or corporation to solicit from door to door, or otherwise, in the Borough of Avalon for the procurement of gratuities or contributions for any cause, whether charitable or otherwise, or soliciting for orders from door to door for the sale of goods, without first registering the name or names of the organization and its solicitor, or solicitors, with the Mayor and/or Police Department of the Borough of Avalon, at the Borough Hall, Avalon, Pennsylvania, prior to such solicitation.

Any person who violates or permits a violation of this article shall, upon being found liable therefor, pay a fine of not more than $600, plus court costs and reasonable attorneys’ fees incurred by the Borough in the enforcement proceedings. If the penalty is not paid, the Borough shall initiate a civil action for collection in accordance with the Pennsylvania Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense, and each section of this article that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this section, the Borough may enforce this article in equity in the Court of Common Pleas of Allegheny County.

The going in and upon private residences in the Borough of Avalon, Pennsylvania, by any solicitor, peddler, hawker, magazine, periodical or book salesman, itinerant merchant or transient vendor of merchandise other than those hereinafter designated, not having been requested or invited so to do by the owner or owners, occupant or occupants of said private residences, for the purpose of soliciting orders for the sale of goods, wares and merchandise, including therein magazines, periodicals and books, or disposing of the same, or peddling or hawking the same, shall be and the same is hereby prohibited.
The going in and upon a private residence in the Borough of Avalon, by any one of those specified in § 284-3 hereof, without request or invitation as aforesaid, shall be and the same is hereby further declared to be a nuisance and a business offensive to the inhabitants of the Borough of Avalon.
Nothing contained in this article shall be construed to apply:
A. 
To farmers selling their own produce;
B. 
To the sale of goods, wares and merchandise, donated by the owners thereof, the proceeds whereof are to be applied to any charitable or philanthropic purpose; or
C. 
To any manufacturer or producer in the sale of bread and bakery products, or milk and milk products.

This article shall in no event be construed to repeal any former ordinance of the Borough of Avalon, or part thereof, unless this article be in direct contradiction thereto.
