1. 
The Board of Supervisors of Newtown Township hereby adopts regulations governing the subdivision and development of land within the Township.
2. 
These regulations shall become effective five days after adoption, and shall remain in effect until modified by the Board of Supervisors.
3. 
All previous Township Subdivision and Land Development Regulations and subsequent amendments thereto are hereby repealed.

An Ordinance establishing rules, regulations, and standards governing the subdivision and land development of land within the Township setting forth the procedures to be followed by the Board of Supervisors and Planning Commission and other authorized municipal personnel in administering these rules, regulations and standards, and setting forth the penalties for the violation thereof.

These regulations shall be known and may be cited as "The Newtown Township Subdivision and Land Development Ordinance of 1985."

The regulations are adopted for the following purposes:
1. 
To assure sites suitable for building purposes and human habitation and to provide for the harmonious development of the Township of Newtown in conformance with the Comprehensive Plan and Zoning Ordinance.
2. 
To assist orderly, efficient and integrated development of land.
3. 
To provide for the coordination of new and existing streets and public utilities.
4. 
To provide for efficient and orderly extension of community services and facilities at minimum cost and maximum convenience.
5. 
To secure equitable handling of all subdivision plans by providing uniform procedures and standards for observance, both by subdividers and the Township.
6. 
To insure the proper provision of open space for recreation and the proper location of sites for future public building, community facilities, industrial, research, administrative and shopping areas.
7. 
To provide for flexibility, economy and visual character in the layout and design of subdivisions and development.
8. 
To insure that proper provisions shall be made for drainage, water, sewerage and other needed improvements.
9. 
To insure that land to be subdivided shall be of such character that it can be used for building purposes without danger to health or peril from fire, flood or other menace.
The integration of all these services will be of mutual advantage to the developer and the Township in providing the necessary services at minimum cost and maximum convenience, thereby creating conditions favorable to the health, safety, morals and general welfare of the citizens of the Township.

1. 
Township Authority. Section 501 of the Pennsylvania Municipalities Planning Code (Act 247) provides that Newtown Township may regulate subdivision and land development within the Township by enacting a subdivision and land development ordinance.
2. 
Applicability. This Chapter 22 requires that all plans for the subdivision or development of land lying within the Township be submitted for approval to the Newtown Township Board of Supervisors. All such plans shall be reviewed by the Newtown Township Planning Commission and such other bodies as are required by Township, State and Federal regulations, ordinances or statutes prior to submission to the Board of Supervisors, in accordance with procedures set forth in this Chapter 22.
3. 
County Authority.
A. 
The Bucks County Planning Commission shall review and report on each subdivision or land development plan (pursuant to Section 502 of the Pennsylvania Municipalities Planning Code (Act 247)) before local approval and recording.
B. 
The submission of the plans to the Bucks County Planning Commission for review and report shall be as provided in Part 3. After consideration of the County report, the Planning Commission and the Board of Supervisors may proceed to preliminary and final action, unless the County fails to act within the time allocated to it, in which case the Board may act without their recommendation.

The provisions of this Chapter 22 shall be held to be minimum requirements to meet the purposes stated herein. Where the provisions of this Chapter 22 impose greater restrictions than those of any statute, other ordinance or regulation, the provisions of this Chapter 22 shall prevail. Where the provisions of any statute, other ordinance or regulation impose greater restrictions than those of this Chapter 22, the provisions of such statute, ordinance or regulation shall prevail.

No lot in a subdivision may be sold; no permit may be issued, to erect, alter, or repair any building upon land in a subdivision or proposed land development; and no building may be erected in a subdivision or land development, nor any site work be done in a proposed subdivision or land development, unless final plans for such subdivision or land development shall have been (1) Prepared and signed and sealed by a professional engineer or land surveyor duly and currently registered in the State of Pennsylvania, provided however, that the record plan shall be signed by a land surveyor currently registered and licensed in Pennsylvania, (2) submitted to and approved in writing thereon by the Newtown Township Supervisors and (3) recorded in the Bucks County Recorder of Deeds Office in Doylestown, Pennsylvania and until the required improvements in connection therewith have either been constructed or the completion thereof has been assured by means of a proper financial security to guarantee completion.

Any property located within Newtown Township which is designated as open space or is subject to a restriction against further subdivision, whether by a notation on a subdivision plan and/or restriction in a deed, shall not be further subdivided, regardless of an intervening zoning change.
