This Part shall be known and may be cited as the "Penn Township
Park Rules and Regulations Ordinance."

These regulations are established to govern the conduct of members
of the public in parks and recreational facilities and other properties
established and/or maintained by the Township and to protect and preserve
public property.

1. The following terms shall have the meanings indicated:
PERSON
Any individual, corporation, association, partnership, firm,
trust, estate or legal entity whatsoever which is recognized by the
law as the subject of rights and duties.
POLICE DEPARTMENT
The Northern Lancaster County Regional Police Department
or any successor entity whose primary jurisdiction includes the territorial
limits of the Township.
TOWNSHIP
The Township of Penn, Lancaster County, Pennsylvania.
TOWNSHIP PROPERTY
Any real estate owned or leased or maintained in whole or
jointly by the Township.
2. As used in this Part, words expressed in the singular include their
plural meaning, and words expressed in the plural include their singular
meaning. Words in the masculine gender include the feminine gender
and the neuter.

1. From and after the enactment of this Part, the following regulations
shall be in effect for the proper conduct or behavior of all persons
using any facilities of the Township or being upon any Township property:
A. No person shall permit any dog or other animal to run at large within
Township property. All dogs and other animals shall be attended to
and maintained on a leash at all times. All persons shall be responsible
to remove feces deposited by his or her animal.
B. No person shall discharge within any Township park or recreational facility any firearms as that term is defined by § 6120(b) of the Pennsylvania Uniform Firearms Act, 18 Pa.C.S.A. § 6120(b), except for the justifiable use of force as authorized by Chapter
5 of the Pennsylvania Crimes Code, 18 Pa.C.S.A. § 501 et seq. No person shall use or possess within any Township park or recreational facility any bow and arrow, sling shot, air rifle or any other device (other than firearms as defined above) capable of throwing any projectile of any sort, including the hand throwing of rocks or stones intended to be used as weapons. This section shall not be operative in any specific area now designated or to be designated in the future by the Township as a rifle range, archery range, or any other specific area whose purpose is to allow the activities otherwise prohibited by this section.
C. No person shall transport, possess, or be under the influence of
alcohol or controlled substances.
D. No person shall remove, injure, or damage anything natural or physical
on Township property.
E. No person shall deface or destroy any posted signs.
F. No person shall litter or discard debris of any kind on Township
property, except into appropriate containers.
G. No person shall operate any motor vehicle on any path. Pedestrians,
bicycles, skateboards and rollerblades are permitted on paths.
H. Interference by persons on a bicycle, skateboard and rollerblades
with pedestrian traffic on a path is prohibited.
I. All persons are to maintain appropriate and respectful behavior at
all times while on Township property. Loitering and/or public disturbances,
including, but not limited to, lewd or vulgar and excessive noise
is prohibited on Township property.
J. Driving or chipping of golf balls is prohibited on Township property.
K. No person shall park any vehicle on Township property before dawn
or after dusk without written permission from the Township. This prohibition
shall not apply to persons parking at the Township Municipal Building
to attend meetings or other functions being held in the evening at
the Township Municipal Building.

L. No person
shall park unlicensed and/or unregistered vehicles on Township property.

Township property shall be open to the public from dawn to dusk
each day unless different hours are established by the Board of Supervisors.

The Board of Supervisors may, by resolution, from time to time
establish additional rules and regulations and, if it so desires,
alter, amend and supplement the rules and regulations herein established
for the operation, use and protection of the Township property. Such
rules and regulations may include but shall not be limited to regulations
governing the times for presence of persons therein, the nature and
extent of the permitted and prohibited uses thereof, and such other
matters as the applicable approval authority may deem necessary or
proper for the protection of the Township property and the persons
and properties therein.

This Part may be enforced by the office of the Police Department
and by the Code Enforcement Officer.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof in an action brought before
a magisterial district judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not less than $25 nor more than
$1,000 plus the cost of prosecution for each and every offense, plus
the cost of all damages inflicted upon Township property, and, in
default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this Part continues
or each section of this Part which shall be found to have been violated
shall constitute a separate offense.
