It shall be unlawful for the owner of any dog or any other person responsible to said owner, whether the dog bears a proper license tag or not, to permit such dog to run at large upon the outdoor area of any public or private property in Manchester Township.

1. 
It shall be unlawful for any person to confine a dog in an open air enclosure, including a fenced yard, where its barking may disturb the quiet of the neighborhood after 10:00 p.m. or before 6:00 a.m., prevailing time. Said dog shall be confined within a relatively sound-proof building with closed doors and windows during those hours.
2. 
It shall be unlawful for any owner or persons responsible to said owner to permit the continual daylight barking of any dog or dogs. Continued daylight barking shall mean the barking of any dog for a continuing period of 30 seconds or more on three or more occasions during any 20 minute period.

It shall be unlawful for any person owning, keeping or walking any dog to permit his or her dog to discharge such animal's excreta upon any public or private property within Manchester Township, other than the property of the owner of such dog, if such person does not immediately thereafter remove and clean up such animal's excreta from the public or private property.

It shall be unlawful for the owner of any dog to permit the accumulation of excreta from such dog in a pen or enclosure, including a yard or at any place within Manchester Township where such accumulation creates a threat to the health of any person or the odor therefrom pollutes the air inhaled by any neighbor or other person.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a district justice in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense.

This Part shall be known as and may be cited as the "Manchester Township Animal Ordinance."

1. 
The intent of this Part is to:
A. 
Promote the general peace, health, welfare, and safety of the community.
B. 
Encourage the proper safe care and management of animals within the Township.
C. 
Minimize danger to public health by setting standards for sanitation and drainage.

1. 
The following words and terms, as used in this Part, shall have the meaning hereby respectively ascribed thereto, except where the context clearly indicates a different meaning:
ANIMAL
Any domestic animal or fowl, any wild animal or any household pet.
DOMESTIC ANIMAL
Any equine animal, bovine animal, sheep, goat, and pig.
HOUSEHOLD PET
Any dog, cat or other small animal normally and ordinarily kept in or permitted to be in the dwelling of its owner.
KEEP
To feed, house, care for or otherwise assume responsibility for, regardless of ownership.
PERSON
Any natural person, partnership, association, film or corporation.
SMALL ANIMAL
Any animal such as a rabbit, hare, guinea pig, rat, mouse, or chinchilla; and any domestic fowl or bird such as a chicken, turkey, goose, duck, parrot, parakeet, canary or pigeon (except homing pigeons).
WILD ANIMAL
Any mammal other than domestic animal or small animal as defined herein or any household pet as defined herein and any feral animal.
2. 
In this Part, the singular shall include the plural, the plural shall include the singular, and the masculine shall include the feminine.

1. 
It shall be unlawful for any person to keep any domestic animal or small animal, except household pets, except as provided in this section.
A. 
The keeper of every such animal shall confine the same in such a manner sufficient to keep such animal on his or her own property, unless confined, on a leash or on the property of another with permission.
B. 
Any enclosure for an animal shall be maintained in a clean and sanitary condition at all times. Such enclosure shall be of a size conducive to good sanitation practices and adequate and sanitary drainage facilities shall be provided.
C. 
All waste shall be disposed of promptly in a sanitary manner.
D. 
The keeper of such an animal shall also comply with the provisions of the Manchester Township Zoning Ordinance [Chapter 27].
2. 
It shall be unlawful for any person to keep any household pet, except as provided in this section:
A. 
If any such pet shall be kept in a dwelling owned or occupied by its owner, such owner shall be required to follow such procedures and practices as to sanitation to insure that no public nuisance shall be created or maintained and no threat to the health of persons living elsewhere than in such dwelling shall be created.
B. 
Any such pet shall be kept confined to its owner's or keeper's property unless on a leash or on the property of another with permission.
3. 
It shall be unlawful for any person who keeps any household pet, domestic animal, small animal, or feral domestic cat as provided in Subsection 4 of this section to allow it to do the following:
A. 
To make any loud or harsh noise or disturbance which shall interfere with or deprive the peace, quiet, rest, or sleep of any person within the Township.
B. 
To defile, befoul, corrupt, or otherwise desecrate any sidewalk, walkway, other public property or the property of another.
C. 
On lots of two acres or less, to allow the accumulation of waste so as to cause noxious odors on the property of another.
4. 
It shall be unlawful for any person to keep any wild animal; provided, however, that it shall be lawful for a person to keep a feral domestic cat or cats if that person or another has trapped, neutered and released the cat or cats back into the wild. Such person shall furnish proof of neutering to Manchester Township or its enforcement or police officers.

Any person who shall violate any provision of this Part shall, for each and every such violation, upon conviction thereof, be sentenced to pay a fine of not less than $250 nor more than $1,000 and costs of prosecution, and, in default of payment of such fine and costs, to imprisonment for not more than 30 days; provided, however, that each day on which any such violation shall take place shall constitute a separate violation.

Any violation of this Part that would also violate any state law shall be prosecuted under that state law and not under this Part.
