1. From and after the enactment of this Part the following regulations
shall be effective for the proper conduct or behavior when using the
facilities of Memorial Park, including pools, of the Borough of Shillington:
A. Alcoholic beverages shall not be permitted in the park or pool areas
at any time.
B. Trash, garbage and all other litter must be placed in containers
provided for this purpose.
C. No one shall remove, molest, injure or damage anything natural or
physical within the park and pool areas.
D. Motor vehicle operators shall obey posted speed limits and parking
restriction signs, and use only roads and parking areas open to the
public for vehicular traffic.
E. Parking on the greens and planted areas is prohibited unless permission
has been granted by the Chief of Police, Director of Recreation or
Pool Manager.
F. The operation of unlicensed motorized vehicles and snowmobiles is
prohibited in the park area.
G. Possession or discharge of any type of firearms, bows and arrows,
air guns, slingshots, air rifles, fireworks, or explosives is prohibited.
H. Swimming in the dam (known as the "Porgey") is prohibited.
I. Memorial Park will be open for the use of its facilities from 8:00
a.m. until 9:00 p.m. Permission to remain in the park after 9:00 p.m.
shall be obtained from the Director of Recreation or Chief of Police.
Pets shall not be allowed in the pavilions and/or pool areas.
J. No person or persons shall enter or use the swimming pool or any
building or buildings appurtenant thereto at any time after the closing
hour: viz., 8:00 p.m., standard time, or 9:00 p.m., daylight-saving
time, for any purpose, except as hereinbefore provided.
K. No person or persons shall commit a breach of the peace or be guilty
of vagrancy, riotous or disorderly conduct; engage in fighting, assaults,
quarreling, or inciting others to fight, assault, or quarrel, or to
engage in any other unlawful act tending to imperil the personal security
or endanger the property of the Borough.
L. No person or persons shall use publicly profane, blasphemous, or
indecent language, or commit open lewdness or any act of public indecency,
make any indecent exposure of the person, or be found in a state of
intoxication or drunkenness.
M. No person or persons shall make willfully or cause to be made any
loud, boisterous, or unseemly noise or disturbance to the annoyance
of the peaceable occupants thereof and residents nearby.
N. No person or persons shall be permitted to hit golf balls within
the Shillington Memorial Park.
O. Smoking is hereby banned in the Shillington Memorial Park pool area
which is specifically designated as the fenced area surrounding the
swimming pool.

Any person who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine not exceeding $1,000, costs of prosecution, plus costs of all damage inflicted on Memorial Park property, and in default of payment thereof, shall be subject to imprisonment for a term not to exceed 30 days, except than any person, upon conviction of violating §
16-101, Subsection 1O, shall be sentenced to a fine of not less than $25 in addition to any other penalty specified herein.

Pavilion use will be by permit (rental) only from May 1 through
September 30 in each and every calendar year. No use will be allowed
by individuals or groups that have not obtained a permit.

Only Shillington residents and residents of the Governor Mifflin
School District may apply for a permit to rent a pavilion.

The individual renting the pavilion must be at least 21 years
of age. The renter must be present during the pavilion use. The renter
shall be responsible for the conduct of those using the pavilion under
his/her/their permit and the condition of the pavilion following its
use. The group in attendance may not exceed the maximum listed for
each pavilion.

Permits may be obtained at the Shillington Town Hall Monday
through Friday, during regular business hours, beginning April 15.

The costs of permits will be established by Borough Council
by resolution. Permit fees may be waived for civic groups located
within the Borough of Shillington.

Pavilions will be rented by one-day periods for the hours the
park is open only. No rain checks or refunds are given for inclement
weather or the inability of the renter to use the pavilion unless
otherwise excused by Borough Council.

The permit must be conspicuously displayed at the pavilion in
the holder provided for that purpose during the rental period.

No alcoholic beverages are permitted at anytime in the pavilion
or park area.

Persons using the pavilion may removed for violating the posted
rules of the Shillington Memorial Park adopted by the Borough Council
from time to time by Resolution.
