This Part shall be known and may be cited as the "Manchester Township Water District No. 1 Ordinance."

To provide for the public health, safety and welfare, the Supervisors of Manchester Township, York County, Pennsylvania, are hereby authorized and empowered to enter into an agreement with the York Water Company and others for the purposes of creating a water district in which there will be installed public water mains for public water service. The water district shall be called the "Manchester Township Water District No. 1" and shall encompass the following areas of the Township:
Approximately 710 feet of six-inch pipe on Maurice Street northwardly from Church Road to an end; approximately 662 feet of six-inch pipe on Anna May Street northwardly from Church Road to an end; approximately 695 feet of twelve-inch pipe on Church Road westwardly from Maurice Street to an end east of Stillmeadow Lane; approximately 1,278 feet of twelve-inch pipe on Church Road eastwardly from an end approximately 500 feet east of Maurice Street to an end west of Lewisberry Road.

All persons owning any building now erected within the Manchester Township Water District No. 1 that is occupied or intended for human habitation and is accessible to the public water system, and all persons hereafter erecting any new building within that District that is intended for human habitation or occupancy and is accessible to the public water system, may, at their own expense, make connection of such building to the public water system.

All connections to the public water system shall be made in accordance with the applicable Township ordinances then in effect and the rules and regulations thereunder and in accordance with the rules, regulations and specifications from time to time in effect and specified in the York Water Company's tariffs and operating policies.

Upon the connection of any building to the public water system, the internal water and plumbing system of such building connected to any individual on-lot or private water system shall be immediately disconnected. Thereafter, such individual on-lot or private water system shall not be used for human consumption, bathing, other household uses, or for sanitary purposes. Existing on-lot or private water systems may, with the approval of the York Water Company, be maintained and used for irrigation, fire protection, filling of swimming pools or other purposes not prohibited by said company's operation policies. In no event shall there be any cross-connection of any on-lot or private water system with the system supplied by the public water system.

Any person who shall connect a building to the public water system within 90 days of receiving notice from the York Water Company that the system is ready to accept connections shall not be required to pay a connection fee.
2. 
Any person desiring to connect to the public water system more than 90 days after receiving notice that the system is ready to accept connections shall not do so unless a connection fee, payable to Manchester Township, is paid, according to the following schedule:

Application for water service after the initial ninety-day connection period shall be made to Manchester Township.

Any person who shall connect a building to the public water system shall thereafter be responsible to pay the York Water Company for such service at its rates in effect for such service.

The Township, in its agreement with the York Water Company, has designated the company as its agent to do and perform certain acts for the Township regarding the Manchester Township Water District. Wherever the York Water Company is so designated, either expressly or by implication, in the agreement or this Part, said Company, after execution of the agreement, is hereby authorized to act, subject to the terms and provisions of the agreement and this Part.

Any person who shall fail or refuse to perform any act, duty or obligation imposed by this Part shall, upon conviction thereof, be fined not more than $600 and costs of prosecution and, in default of payment thereof, shall be imprisoned for not more than 30 days. A separate offense shall be deemed committed on each day during or on which a violation or failure to comply occurs or continues.
