As used in this Part, the following terms shall have the meanings indicated:
AT LARGE
When any dog is off the property of its owner, custodian or keeper and is not under control of a competent person.
AUTHORIZED PERSON
The animal control officer duly appointed by the Borough.
CONTROL
When any dog is restrained by a leash or at heel beside a competent person and obedient to such person's command or is in a parked or moving vehicle or within the property limits of its owner, custodian or keeper.
LICENSED
A dog with a collar or harness affixed with a current valid license tag issued by the Treasurer of Chester County, Pennsylvania.

It shall be unlawful for the owner, custodian or keeper of any dog (whether licensed or unlicensed) to allow such dog to run at large at any time either upon any of the streets, alleys or public grounds in the Borough of Oxford or upon the property of another than the owner, custodian and keeper of such dog.

It shall be the duty of the authorized person who witnesses any dog running at large, or upon information received of any dog so running at large in conflict with § 2-102, to seize such dog and to remove it to the Borough animal detention area.

It shall be the duty of the authorized person to:
A. 
Use any reasonable means to seize and control such dog for purposes of impoundment. If such dog presents an immediate danger to person or property in the judgment of the authorized person, he shall have the privilege of killing such dog without liability for damages for such killing.
B. 
Report the impoundment of such dog to the Oxford Police Department, together with all available information of ownership.
C. 
Post a notice of such impoundment upon the bulletin board in the Borough Building if such dog is unlicensed and no information can be obtained of such dog's ownership.
D. 
Notify the owners of licensed dogs by certified mail of impoundment, with time and conditions of redemption.
E. 
Provide proper and humane care for impounded dogs and make periodic inspection of the detention area.
F. 
Transport unredeemed dogs from the detention area to the animal shelter of the Chester County Society for the Prevention of Cruelty to Animals when such dogs shall become subject to the rules and regulations of such organization.
G. 
Submit periodic reports as prescribed by Borough Council.

1. 
Licensed. Impounded licensed dogs may be redeemed by their owner or proper agent within five days after date of notice provided in § 2-104, Subsection 1D, upon payment of the charges incurred for such dog's seizure and impoundment.
2. 
Unlicensed. Impounded unlicensed dogs may be redeemed by their owner or proper agent within two days after notice of posting provided in § 2-104, Subsection 1C, upon payment of the charge incurred for such dog's seizure and impoundment and a current valid license to be applied for and the tag affixed to a collar on such dogs.
3. 
Impounded dogs shall be considered unredeemed unless the provisions of Subsections 1 and 2 are fully complied with and, as such, shall be transported at the expiration of the time limitations as provided in § 2-104, Subsection 1F.

Rates for such charges for the seizure and confinement of dogs running at large shall be determined from time to time by Borough Council and posted in the Borough Offices.

It shall be unlawful for the owner, custodian or keeper to allow any animal to run at large which becomes a danger to the welfare and safety of persons and property. Any police officer or authorized animal control officer shall have authority to seize and impound such animal, which shall be subject to all provisions and procedures hereinbefore provided relating to dogs.

The first two times a dog is seized, the owner shall pay a fine of $15 to the Borough as well as reasonable fees for keeping the animal in a kennel in an amount as established from time to time by resolution of the Borough Council.
2. 
Any person allowing a dog to run at large a third time in violation of this Part shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fines and cost, to a term of imprisonment not to exceed 30 days.
3. 
Any person violating any provision of this Part which is not related to dogs unlawfully running at large, upon conviction thereof, shall be sentenced to a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day on which a violation shall continue shall be deemed a separate offense.
