There is hereby established a merit system Police Department of the City pursuant to Section 85.541, RSMo., as amended.

The Police Department shall consist of the Chief of Police and such additional subordinate Police Officers and personnel as the Council may prescribe.

The Mayor shall be required to appoint or promote from a list of eligibles certified by the Personnel Board established under Article III of this Chapter, but may reject in total any list and require the Board to certify a new list.

Subject to the provisions of the merit system Police Department, the officers who are appointed shall hold office for an indefinite term, unless sooner removed, and shall possess the same qualifications, be commissioned and take the oath of office, as is required of the Chief of Police, and shall have the same power and authority to execute warrants, subpoenas, writs or other processes and make arrests as is vested in the Chief of Police by this Article or other City ordinance.

The Chief of Police and all officers of the Police Department of the City are authorized to contact any other Police Department or Law Enforcement Agency requesting their assistance and when contacted by any other Police Department or Law Enforcement Agency are directed to render such assistance as requested considering however, at all times, the needs of the citizens of the City before doing so.

A. 
There is hereby established the office of Police Chief who shall be appointed by the Mayor with the advice and consent of the City Council, and may be removed at any time upon the following of due procedure.
B. 
The office of Police Chief shall be excluded from the merit system.
C. 
The Police Chief shall serve as provided by Statute.
D. 
The Chief of Police shall be a conservator of the peace and shall be active and vigilant in enforcing all provisions of the ordinances of the City in relation to nuisances and offenses and in the preservation of the public peace and good order within the City and, in the discharge of his duties, shall at all times be subject to the orders of the Mayor only and shall consider himself/herself liable for duty at all times within the limits of the City and be prompt to act whenever it is necessary.

The Chief of Police, in all matters pertaining to the duties of his/her office concerning which there is no specific provisions of this Article or other City ordinance, shall be governed by the laws of the State regulating the duties of Law Enforcement Officers, as far as they may be applicable.

In addition to the duties prescribed in this Article, the Chief of Police shall perform such duties as are prescribed by other ordinances of the City or by resolution of the City Council, or any Statutes of the State.
