A. There is hereby created the office of "City Engineer" of the City
of Kimberling City.
B. The City Engineer shall be appointed by the Mayor, with the consent
of a majority of the members of the Board of Aldermen, and shall hold
office for a term of one (1) year or until his successor is appointed
and qualified.
C. The compensation of the City Engineer shall be fixed by resolution
of the Board of Aldermen.
D. The City Engineer shall be at least twenty-one (21) years of age.
He shall take the oath of office required of other City Officers.
He will not, during the term of his office, have any interest in any
contract made with the City of Kimberling City for public work of
any character.
E. Powers And Duties. The City Engineer shall have charge of:
1.
The designing, construction, reconstruction, supervision, and
repair of all municipal buildings, structures, facilities and properties.
2.
The lighting of public streets and ways, the laying of conduits,
the location of construction or utility poles and all other structures
in or over public streets and ways, the granting of all permits to
excavate upon public streets and properties or to make any special
use thereof.
3.
The construction, reconstruction, repair and maintenance of
all public streets, sidewalks, and other public ways.
4.
The collection and disposal of garbage and other refuse and
treatment and disposal of sewage.
5.
The issuance and revocation of all building permits, and the
administration of all building and zoning ordinances and codes.
6.
The issuance of plumbing, electrical and all other construction
permits and the inspection of gas, plumbing, electrical wiring, heating
installations and safety equipment, in all buildings and structures
within the City. The inspection of weights and measures and such other
inspectional duties as may be prescribed by ordinance.
7.
The operation of any City garage and all City construction,
maintenance and repair equipment.
8.
The making and keeping of all necessary plats, surveys and drawings
and the preparation of all estimates and reports relating to public
works as may be required by the Mayor or Board of Aldermen.
9.
The operation of the water plants and all facilities for the
acquisition and distribution of water and all other utilities which
the City may operate; the administration of all regulations prescribed
by the Board of Aldermen governing the furnishing of water and other
utility services operated by the City; the making and keeping of all
records of the location, depth and connection of all underground structures,
pipes, conduits and equipment.

The performance of such additional duties not herein specifically
set out as may be required of him by law, by ordinance, or Mayor.
F. In the absence of a City Engineer, the Mayor, with approval of the
Board of Aldermen, shall have authority to assign any or all duties
of a City Engineer to a similarly responsible City Official provided
that person has qualifications prescribed by City ordinance and Missouri
law.
G. Liability. The City Engineer in the performance of his duties herein
described or such duties not specifically described as may be required
of him by law, by ordinance, or by the Board of Aldermen shall not
thereby render himself liable personally, and he is hereby relieved
from all personal liability for any damage that may accrue to persons
or property as a result of any act required or permitted in the discharge
of his duties.
H. Any suit brought against the City Engineer, city employee, or persons
designated by the City Engineer or Board of Aldermen to assist him
shall be defended by the Department of Law or City Attorney until
the final termination of the proceedings.
