The Board of Aldermen hereby finds it in the public interest
of the City to establish a waterworks operated and maintained by the
City of Kimberling City, Missouri.

A. The water system shall be considered as made up of two (2) parts:
1.
The public potable water system; and
2.
The consumer's water system.
B. The public potable water system shall consist of the source facilities
and the distribution system, and shall include all those facilities
of the potable water system under the control of the Director of Public
Works up to the point where the consumer's water system begins.
C. The source shall include all components of the facilities utilized
in the production, treatment, storage, and delivery of water to the
public distribution system.
D. The public distribution system shall include the network of conduits
used for delivery of water from the source to the consumer's water
system.
E. The consumer's water system shall begin at the meter connection which
is utilized in conveying water from the public distribution system
to their points of use.

A. Powers And Duties. The City of Kimberling City, by and through the
Mayor and the Board of Aldermen, shall have full control and management
of the waterworks system of the City and shall make all contracts
for supplies and improvements and manage the business of said waterworks
system. The Mayor, with the confirmation of the Board of Aldermen,
shall employ such assistants and employees as may be necessary for
the operation of the waterworks system, and the Board of Aldermen
shall have power to fix the water rates so as to raise funds sufficient
for the following purposes:
1.
To pay the current running expenses for maintaining the waterworks
system and provide for such extensions and renewals as may become
necessary;
2.
To provide for the payment of the interest and principal on
future bonded indebtedness;
3.
To provide for such reserve funds and accounts as set forth
and required to comply with (Bond ordinance).
B. The Board of Aldermen may adopt such reasonable rules and regulations
for the enforcement and collection of all water rate fees as it may
deem expedient.
C. The Board of Aldermen shall have the power to make rules and regulations
governing use of and connections with the water distribution system
of the City.

A. No connections with a water main shall be made by any person other
than a City employee. All such connections shall be made by or under
the supervision of the Director of Public Works. Applications for
such connections must be made to the City.
B. No fee shall be paid for the connection, as each new owner of a site
where there has not previously been a water meter installed shall
pay to the City the costs for the meter. Fees for the installation
of said meter shall be paid according to the schedule established
below. The cost for the meter and the cost of installation shall be
paid prior to obtaining water service.

C. These charges shall be for installation of the meter pit and all
necessary hardware, including the appropriate meter size. For all
other meter installations, limited to meter installation only, the
charge will be four hundred fifty dollars ($450.00).

Owners shall sign up for water service at the time of purchase
of the building permit. A seventy-five dollar ($75.00) deposit will
be paid at that time when combined service is available. When the
residence is sold, the developer will be billed for all water used
as per the meter.

Application to have water turned on shall be made in writing
to the Utility Clerk and shall contain an agreement by the applicant
to abide by and accept all of the provisions of this Article as conditions
governing the use of the City water supply by the applicant. A minimum
deposit of seventy-five dollars ($75.00) for non-business, and a business
shall pay based upon their projected usage, not to exceed two (2)
times the normal billing based upon actual usage for a period of six
(6) months, with each such application.

A. No water shall be turned on for service in new construction in which
the plumbing does not comply with the ordinances of the City, provided
that water may be turned on for construction work in unfurnished buildings,
subject to the provisions of this Article.
B. All plumbing fixtures and methods of installation shall comply with
the requirements of the applicable City ordinances.

A. It is hereby declared unlawful and an offense for any person or persons
to knowingly use water from the said municipal system unless said
water is metered as provided herein.
B. No water from the City water supply shall be turned on for service
into any premises by any person but the Director of Public Works or
some person authorized by him/her to perform this service, except
in case of emergency.
C. No person shall attach a device to a water line to receive water without benefit of a meter installed by the City. Also, no person shall damage or destroy City-owned property such as the water meter or the electronic radio transmitter. Such will be a direct violation of this Article and will be subject to a citation and a fine as defined in Section
700.210.

A. All premises using the City water supply must be equipped with an
adequate water meter furnished by the City but paid for by the customer,
provided that such water service may be supplied temporarily by the
City at a flat rate of charge until such meter may be installed.
B. Before any premises are occupied, a water meter shall be installed
as herein required, an application shall be made for such water service
at the rate of charge or no water shall be furnished to such premises.

Meters shall be installed in a location that will be easy of
access and located in the front utility easement.

All water meters installed as herein provided are hereby declared
to be and to remain the exclusive property of the City of Kimberling
City, Missouri, and it is hereby declared unlawful and an offense
for any persons to damage, destroy, steal or tamper with in any manner
whatsoever with any water meter or with any other part of said water
system.

All property owned by the City and used for public purposes
shall be exempt from paying service fees for water usage on said public
properties, provided that any property utilized by tenants property
who are required by agreement to pay utilities shall be subject to
water usage fees.
