A Township Planning Commission, to be composed of five members,
appointed as provided by law (53 P.S. § 10202), is hereby
created in and for the Township of Penn. The Planning Commission shall
perform all duties and may exercise all powers conferred by law upon
municipal planning agencies; provided, the Planning Commission previously
created in and for the said Township shall constitute the tenure of
any of the members thereof, but any and all vacancies in the said
Commission hereafter occurring shall be filled in the manner and for
the term provided in the law governing municipal planning commissions
in effect at the time of the happening of the said vacancy.

This Township shall join with Manheim Borough and County of
Lancaster in accordance with the Pennsylvania Intergovernmental Cooperation
Act by entering into the Intermunicipal Agreement which is adopted
by reference with the same effect as if it had been set out verbatim
in this section and a copy of which shall be filed with the minutes
of the meeting at which this Part was enacted.

This Township is authorized to enter into the Intermunicipal
Agreement for the purposes contained therein. This action is to be
taken by the officials or employees of the Township designated for
this purpose, pursuant to general or specific instructions issued
by the Board of Supervisors.

1. As required by the Intergovernmental Cooperation Act the following
matters are specifically found and determined:
A. The conditions of the agreement are set forth in the Intermunicipal
Agreement referred to in § 1-322.
B. This Borough's participation in the Manheim Regional Emergency Management
Agency shall be for the period extending through December 31, 2009,
and may/will be extended indefinitely until, notice of termination
is given as set forth in the Agreement referred to in § 1-322.
C. The purpose and objectives of the Intermunicipal Agreement are to
enter into an intergovernmental contract to form the Manheim Regional
Emergency Management Agency for the purpose of sharing costs to provide
emergency planning.
D. Each member will annually contribute $1,000 from its general fund
for the operation of the Manheim Regional Emergency Management Agency.
The amounts may be increased as set forth in the Agreement referred
to in § 1-322.

The annual contribution may be used for the acquisition of materials
and supplies as well as training and public exercises.
(2)
In addition portions of the annual contribution may be appropriately
used in relationship to preparation of emergency response plans, software
and actual emergency responses.
(3)
Unused portions of the annual contributions shall be placed
into an account specifically designated to address the county's new
radio requirements, as they may directly impact this agency.
E. A new entity, the Manheim Regional Emergency Management Agency, shall
be formed.
F. All property, real or personal, shall be acquired, managed or disposed
of by the Manheim Regional Emergency Management Agency.
(1)
Property shall include those items uniquely specific to the
role and charge of the agency.
(2)
An inventory of all real or personal property being placed under
the control of the Manheim Regional Emergency Management Agency including
a listing of all plans and documents that have been adopted and/or
enacted by the respective municipalities shall be attached hereto
as Exhibits.
(3)
The coordinator shall provide an annual update to each of the
municipalities of any real or personal property that has been added
to its inventory and/or control.
G. The Manheim Regional Emergency Management Agency shall not have employees
and shall not have the power to enter into contracts for policies
of insurance or other employee benefits.
