This Chapter shall be known and may be cited as the "Penn Township
Traffic and Parking Ordinance."

Words and phrases, when used in this Chapter, shall have the meanings
ascribed in the Vehicle Code, 75 Pa.C.S.A. § 101 et seq.,
as hereinafter amended, supplemented, modified or reenacted by the
General Assembly of Pennsylvania (hereinafter referred to as the "Vehicle
Code"), unless the context clearly indicates a different meaning.
New Year's Day, Presidents Day, Easter, Memorial Day, Independence
Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day and Christmas.

The Northern Lancaster County Regional Police Department
or any successor entity whose primary jurisdiction includes the territorial
limits of the Township.
Any officer of the Police Department.
Shall be used interchangeably with the word "highway" and
shall have the same meaning as the word "highway" defined in the Vehicle
Code.

All traffic and parking regulations of a permanent nature shall
be enacted as ordinances, as parts of ordinances, as amendments to
ordinances or as amendments to this Chapter.

The provisions of this Chapter, so far as they are the same
as those of ordinances in force immediately prior to the enactment
of this Chapter, are intended as a continuation of such ordinances
and regulations and not as new enactments. The provisions of this
Chapter shall not affect any act done or liability incurred, nor shall
they affect any suit or prosecution pending or to be instituted to
enforce any right or penalty or to punish any offense under any such
ordinances or regulations aforesaid.

The Police Chief or Roadmaster shall have the following powers to
regulate traffic and parking temporarily and in time of emergency:
A.
In the case of fire, flood, storm or other emergency, to establish
temporary traffic and/or parking regulations.
B.
In the case of emergency or to facilitate public works, or in the
conduct of parades, processions or public events, to restrict or prohibit
traffic and/or parking in limited areas for periods of not more than
72 hours.

Such temporary and emergency regulations shall be enforced by the
Police Department in the same manner as permanent regulations. Any
person who shall operate or park a vehicle or tractor in violation
of any such regulations, or who shall move, remove, destroy, injure
or deface any sign or marking erected, posted or made to give notice
of the regulation, shall, upon conviction thereof, be subject to the
penalty set forth in the Vehicle Code or elsewhere in this Chapter
for a violation of such nature, and, in case of a violation for which
no specific penalty is set forth in the Vehicle Code or elsewhere
in this Chapter, to a fine of not more than $25 together with costs
of prosecution.

The Board of Supervisors may, from time to time by resolution,
designate places upon and along the highways in the Township where
for a period of not more than 90 days, specific traffic and/or parking
regulations, prohibitions and restrictions shall be in force and effect,
and shall designate such locations by proper signs and markings. Such
regulations, prohibitions and restrictions shall be effective as if
they had been specified in this Chapter. No person shall operate or
park a vehicle or tractor in violation of any such regulation, prohibition
or restriction, and no person shall move, remove, destroy or deface
any sign or marking erected, posted or made by authority of this section.
Any person who shall violate any provision of this section shall,
upon conviction thereof, be subject to the penalty set forth in the
Vehicle Code or elsewhere in this Chapter for violation of such nature,
and in case of a violation for which no specific penalty is set forth
in the Vehicle Code or elsewhere in this Chapter, to a fine of not
more than $25 together with costs of prosecution; provided, the purpose
of this section is to allow for the testing and experimental determination
of the feasibility and desirability of permanent changes in the ordinances
of the Township relative to traffic and parking.

Police officers are hereby given authority to direct traffic
on the highways of the Township and at intersections thereof and to
enforce the provisions of this Chapter.

No person shall drive a vehicle, other than a human powered
vehicle, upon a sidewalk or sidewalk area except upon a permanent
or duly authorized temporary driveway. Any person who shall violate
any provision of this section shall, upon conviction thereof, be sentenced
to pay a fine of $25 together with costs of prosecution.

2.
School Speed Zones. It is hereby established that there shall be
school speed zones on the following highways and locations and at
the effective hours as indicated where and when the maximum speed
limit for the operation of a motor vehicle or tractor shall be 15
miles per hour during days when the school in the particular location
is open for the attendance of students:

Any person who shall operate a vehicle at a speed in excess of that
established therefor upon any highway or portion thereof as specified
in this section shall, upon conviction thereof, be sentenced to pay
a fine of $35 and, for exceeding a maximum speed limit by more than
five miles per hour, shall pay an additional fine of $2 for each mile
per hour in excess of five miles per hour over the maximum speed limit,
plus costs of prosecution.

The following intersections are hereby established as stop intersections,
and official stop signs shall be erected (or are hereby ratified if
heretofore erected) in such a position as to face traffic approaching
the second-named street (the through street) on the first-named street
(the stop street) in the direction or directions indicated for that
intersection. Every driver of a vehicle approaching the intersection
on the first named or stop street, in the direction indicated in each
case, shall stop the vehicle as required by § 3323(b) of
the Vehicle Code, and shall not proceed into or across the second-named
or through street until he has followed all applicable requirements
of that section of the law.

Any person who violates any provision of this section shall be prosecuted
under §§ 4902(a) and 4902(g)(1) of the Vehicle Code,
75 Pa.C.S.A. §§ 4902(a), 4902(g)(1), and, upon conviction,
shall be sentenced to pay a fine of $150 plus $150 for each 500 pounds,
or part thereof, in excess of 3,000 pounds over the maximum allowable
weight, plus costs of prosecution.
3.
Closing of Certain Highways to Certain Vehicles. It shall be unlawful
for any person to operate any vehicle of the below-identified type
upon any portion of the highways described below; provided, however,
that nothing herein shall prohibit the operation of a commercial vehicle
or tractor upon any highway or portion thereof listed below where
such operation thereon shall be necessary in order to pick up or deliver
any goods, ware, merchandise or material to or from any premises located
upon the highway or portion thereof identified below:

Every vehicle parked upon a highway shall be positioned to the right side of the highway with the right-side wheels within 12 inches of the curb or righthand edge of the highway. On one-way streets, vehicles may be parked with either the right or left side thereof to the curb when headed in the legal direction of traffic, unless parking on such side is otherwise prohibited. Any person who violates any provision of this section shall be subject to the penalties set forth in § 15-123 of this chapter.

No vehicle shall be parked within 15 feet of any fire hydrant.
2.
No vehicle shall be parked within 25 feet of any intersection of
two or more highways.
3.
No vehicle shall be parked within 30 feet of any stop sign, flashing
signal light, yield sign, or traffic control signal.
4.
No vehicle shall be parked within 50 feet of any railroad crossing.
5.
No vehicle shall be parked within 10 feet of a mailbox.

No vehicle shall at any time be parked in front of any private garage or driveway or within a private drive so as to impede or prohibit entrance or exit, unless the vehicle blocking such garage, driveway or private drive is that of the owner of the garage, driveway or private drive. Notwithstanding the foregoing, no vehicle shall be parked in any manner so as to impede or prohibit the passage of emergency vehicles. Any person who violates any provision of this section shall be subject to the penalties set forth in § 15-123 of this chapter.

No vehicle shall remain parked upon any arterial or collector highway for a period in excess of 48 hours. For the purpose of this provision, those roads designated as arterial or collector roads in the Penn Township Zoning Ordinance [Chapter 27] shall be considered arterial and collector highways.
2.
No vehicle shall be parked in a manner which creates a hazardous condition. Any such vehicle shall be subject to immediate removal in accordance with the provisions of § 3352 of the Vehicle Code, 75 Pa.C.S.A. § 3352. Any person who violates any provision of this section shall be subject to the penalties set forth in § 15-123 of this chapter.

No vehicle shall be parked upon either public or private property in a zone which shall have been posted in a manner prescribed by law designating the zone as a handicapped parking area unless such vehicle bears a handicapped registration plate or a disabled American veteran registration plate and is being used to transport a handicapped person or disabled veteran. Any person who violates any provision of this section shall be subject to the penalties set forth in § 15-123 of this chapter.

No vehicle shall be parked upon either public or private property in a designated fire lane which has been so designated in a manner prescribed by law. Any person who violates any provision of this section shall be subject to the penalties set forth in § 15-123 of this chapter.

No person engaged in the business of repairing or maintaining vehicles shall do so while a vehicle is parked upon a highway except in the case of making emergency repairs, at which time necessary and appropriate warning signs and/or safety devices shall be placed or utilized to warn other traffic upon the highway. Any person who violates any provision of this section shall be subject to the penalties set forth in § 15-123 of this chapter.

No person operating or in charge of a motor vehicle shall permit the vehicle to park or stand unattended, upon public or private property, without first stopping the engine, removing the keys and/or placing the ignition switch in the locked position. Any person who violates any provision of this section shall be subject to the penalties set forth in § 15-123 of this chapter.

No person shall park or permit to be parked a trailer, camper trailer, camper, boat and trailer combination, or utility trailer, loaded or unloaded, upon a public highway in excess of 48 continuous hours. Any person who violates any provision of this section shall be subject to the penalties set forth in § 15-123 of this chapter.

Any person who violates any provision of §§ 15-112 through 15-122 of this chapter shall, upon conviction, be sentenced to pay a fine of not more than $15 and costs of prosecution. Provided, it shall be the duty of police officers and parking enforcement personnel of the Township to report to the Police Chief all violations of any provision of this chapter, indicating in each case: the section violated, the license number of the vehicle involved in the violation, the location where the violation took place, and any other facts that might be necessary in order to secure a clear under-standing of the circumstances attending the violation. The police officer or other person making the report shall also attach to or place upon every such vehicle a notice stating that the vehicle was parked in violation of this chapter. The notice shall contain instructions to the owner or driver of the vehicle that if he will report to the office of the Police Chief and pay the sum set forth below, or mail the sum the sum set forth below to the Police Chief, so that it is received within five days after the time of the notice, that act will save the violator from prosecution and from payment of the fine and costs of prosecution prescribed in the first sentence of this section.
3.
Any person who violates any other provision of this chapter shall,
upon conviction, be sentenced to pay the penalties or fines set forth
in the Vehicle Code or elsewhere in this chapter for violations of
such nature, together with costs of prosecution.
