Sewer rentals and charges are imposed upon and shall be collected from the owner of each improved property which shall be connected to the North Lebanon Township sewer system, for use of the sewer system, whether such use shall be direct or indirect, and for services rendered by this Township or the Authority in connection therewith, which sewer rentals and charges shall commence and shall be effective as of the date of connection of each such improved property to the sewer system, and shall be payable as provided herein, in accordance with the following schedule of rates and classifications.

All owners of sewered residential establishments and nonresidential establishments shall pay a sewer rental as determined from time to time by the Supervisors of North Lebanon Township, by resolution.

All owners of sewered residential establishments and nonresidential establishments (metered and non-metered) shall pay such charges for transportation, operation and maintenance, administrative charges in accordance with the resolutions as adopted from time to time by the Board of Supervisors of North Lebanon Township. Any of such charges may be made pursuant to an EDU schedule adopted by the Board of Supervisors of North Lebanon Township by resolution.

In the event that there is not a category established for a sewer customer on the EDU schedule adopted by resolution of the Township, the Township shall establish the EDU's to be assigned to such customer.

Each Billing Unit located in a multiple occupancy unit shall be billed as a separate entity and the foregoing sewer rentals or charges, as appropriate, shall be used in computing the O&M charges applicable to each such billing unit as though such billing unit was in a separate structure and had a direct and separate connection to the sewer system; provided, however, that this paragraph shall not be applicable to a combination dwelling unit and commercial establishment as specified in Classification (3) above.

Exclusion from the sewer system of noncontaminated wastewater may be required of a nonresidential establishment by the Township, or such exclusion may be optional with the owner of the improved property if not required by the Township. When such wastewater is excluded, or when any other portion of the water consumption of nonresidential establishment does not reach the sewer system, sewer rentals shall be based upon total water consumption, less water excluded, as set forth in this § 18-702. Water excluded shall be determined from meters installed and maintained by the owner of the improved property as required and approved by this Township; from estimates made by this Township; or the owner of the improved property may elect to measure wastewater volume actually discharged to the sewer system as hereinbefore provided.
This Township may require the owner of a nonresidential establishment, or the owner of a non residential establishment may elect, to install, pay for, and maintain a meter approved by this Township for measuring quarterly wastewater volumed discharged to the sewer system, in which case sewer rentals shall be based upon the actual volume of wastewater so metered and the rates set forth in this § 18-702.

All owners of metered residential establishments and non-residential establishments connected to the sewer system of the Township shall be required to pay a minimum sewer rental charge per quarter as determined by resolution by the Board of Supervisors of North Lebanon Township and shall be required to pay all other charges as imposed by resolution of the Township. All non-metered customers shall pay a quarterly sewer bill in accordance with a resolution to be adopted by the Board of Supervisors of North Lebanon Township.

Any property owner connected to any North Lebanon Township Municipal sewer line shall be subject to such other rules and regulations as adopted from time to time by the Board of Supervisors of North Lebanon Township. Such customers shall all be subject to special rules and regulations, rates or charges as imposed by the City of Lebanon or its authorized agents controlling the treatment of waste discharges.

Sewer rentals and charges imposed by this Resolution shall be a lien on the improved property connected to and served by the sewer system; and any such sewer rentals and charges which are delinquent shall be filed as a lien against the improved property so connected to and served by the sewer system, which lien shall be filed in the appropriate office of the County of Lebanon, Pennsylvania, as provided by law, and shall be collected in the manner provided by law for the filing and collecting of municipal claims.

Any person who violates or permits a violation of this provision of the Code of Ordinances of North Lebanon Township shall, upon conviction thereof, be sentenced to pay a fine of not less than $100 nor more than $1,000, and/or to be imprisoned for a period not to exceed 90 days. A separate offense shall arise for each day or portion thereof in which a violation is found to exist.

North Lebanon Township may issue a notice to a property owner that is connected to the North Lebanon Township sewer system requiring that the owner allow the inspection of the property to determine the type and number of uses, the type and number of sewer connections, verification that there is no unauthorized discharge into the North Lebanon Township sewer system. In the event that the owner does not permit the inspection of the premises, the owner shall be charged an additional sewer assessment of $450 per quarter until the property owner complies with the notice and allows the inspection.
