It is the purpose and intention of this Part 1 enacted under the police powers of the Township of North Lebanon to regulate and control the collection, removal and disposal of ashes, garbage, rubbish and other refuse materials in a compulsory and universal manner in order to maintain, provide for and protect the health, safety and sanitation of the inhabitants of this Township by the use of the facilities of the Greater Lebanon Refuse Authority.

1. 
All persons within North Lebanon Township must have a collector licensed by the Greater Lebanon Refuse Authority to collect and dispose of any garbage or refuse. Residents must maintain proof of this contracted service for a minimum of two years. Residents choosing to self-haul their garbage or refuse must take such items to the location designated by the Greater Lebanon Refuse Authority and maintain, for a minimum of two years, any weigh slips, receipts and records indicating time, date and details of the disposal. Whenever requested by North Lebanon Township, residents must produce said documentation to the Township within 72 hours of such request.
2. 
All persons within North Lebanon Township shall be required to have their garbage and refuse collected at least once each week. The Board of Supervisors of North Lebanon Township do hereby reserve the right to designate such other industries and businesses within the Township that will require more frequent collection of garbage and refuse where it is deemed necessary to protect the public health. The industries and businesses and the frequency of collection shall be designated by the Board of Supervisors of North Lebanon Township by Resolution.

The following words, terms and phrases when used in this Part 1 shall have the meaning hereinafter ascribed to them, except when the context clearly indicates a different meaning:
ASHES
The residue from the burning of wood, coal, coke or other combustible materials.
GARBAGE
All table refuse, animal and vegetable matter, offal from meat, fish and fowls, fruits, vegetables and parts thereof, and other articles and materials ordinarily used for food which have become unfit for such use or which are for any reason discarded.
PERSON
Any individual, partnership, company, association, corporation or other group or entity.
REFUSE
Is a general term and shall mean all matter and materials which are discarded or rejected by the owners or producers thereof as offensive or useless, or which by their presence or accumulation may injuriously affect the health, comfort and safety of the community; it shall include ashes, garbage, rubbish and other refuse materials, but exclude human body waste.

It shall be unlawful for any person to deposit, dump, spill, throw, place or bury or permit another to deposit, dump, spill, throw, place or bury in or upon any parcel of land, lot, street, highway, gutter or in any alley or in any water or stream, or in any quarry or ditch within the limits of the Township of North Lebanon, except as provided for in § 20-104, any ashes, garbage, rubbish and other refuse and other refuse materials; provided, however, that this prohibition shall not apply in the following situations where the person has obtained the necessary permits and approvals:
1. 
Refuse disposed of on premises owned or leased by the producer of the refuse, provided it is done in a safe, sanitary and nuisance-free manner and in compliance with applicable ordinances.
2. 
Garbage collected under an existing contract with any municipality which has joined in the formation of the Authority.
3. 
Manure, fertilizer and refuse used as fertilizer in farming or gardening.
4. 
Solid wastes generated by or resulting from industrial plants or operations.
5. 
Dead household pets interred in places set apart for that purpose.
6. 
Soil, earth, sand, clay, gravel, loam, ashes, slate, stones, bricks, plaster, cement, leaves branches, trees, sawdust, chips, shavings, wood, grass, straw and corn fodder when used as fill, provided it is done in a safe, sanitary and nuisance-free manner.
7. 
The Board of Supervisors of North Lebanon Township does hereby reserve the right to grant permission to the above six exceptions. Such approval shall be granted by resolution of the Board of Supervisors of North Lebanon Township and if such approval is granted, the exception shall not apply.

The Greater Lebanon Refuse Authority, with the approval and permission of North Lebanon Township, shall designate from time to time the place or places where it will carry on a sanitary landfill operation and all persons shall transport or have another transport their ashes, garbage, rubbish and other refuse materials to one of said designated places where said refuse shall be disposed of in accordance with the rules and regulations of said Authority.

The following refuse shall not be disposed of in accordance with § 20-105:
1. 
Dangerous materials or substances; such as poisons, acids, caustics, infected or highly inflammable materials and explosives, unless prior notice has been given to and permission granted by the Authority in accordance with its rules and regulations.
2. 
Unusual quantities of materials resulting from the repair, demolition, excavation or construction of buildings or structures; such as earth, plaster, mortar, cement and roofing material, unless prior notice has been given to an permission granted by the Authority in accordance with its rules and regulations.
3. 
Nonputrescible fluids in large quantities such as oil, grease, sludge, brine, and the like, unless prior notice has been given to an permission granted by the Authority in accordance with its rules and regulations.
4. 
Materials which have not been prepared for disposal in accordance with the rules and regulations of the Authority.
5. 
Abandoned large machinery or vehicles.
6. 
Dead animals exceeding 75 pounds each in weight.

Garbage and Refuse Collectors (§ 20-107), 1/20/2003, Annual license fee $0/collector within North Lebanon Township.
1. 
Regulations and Licensing of Collectors.
A. 
No person except an authorized collector shall collect garbage from any other person for conveyance through the Township nor shall any person except such authorized collector haul any refuse for any other person from any point within the Township limits to any place or location outside the Township limits.
B. 
An authorized collector is one who has been granted a license by the Greater Lebanon Refuse Authority for the specific purpose of collection and disposal of garbage and refuse.
C. 
All collectors licensed under this Act shall renew their licenses on an annual basis on or before August 1 of each year and shall pay such license fees as are adopted by resolution of the Greater Lebanon Refuse Authority.
D. 
No licensed collector shall dispose of any garbage or refuse collected in the Township except by conveyance to the place of disposal as prescribed herein.
E. 
Failure of any licensed collector to comply with the provisions of this Part shall result in having the license granted herein revoked and shall subject the collector to the penalties as provided herein.
2. 
Collection Vehicles:
A. 
All vehicles used for the collection or disposal of refuse shall have enclosed bodies or shall have the body covered with a tarpaulin or canvas cover.
B. 
All vehicles used for the collection or disposal of garbage, or of refuse containing garbage, shall have water-tight, metal or metal lined bodies of easily cleanable construction, shall be cleaned at sufficient frequency to prevent nuisance or insect breeding and shall be maintained in good repair.
C. 
The name of the licensee shall be displayed in a prominent and legible manner on both sides of all vehicles that are used for the purpose of the transportation of any items as authorized for collection under this Part.
3. 
Prohibited Acts:
A. 
No collector shall transfer garbage or recyclables from one truck to the another while on any public property, highway, street or alley located within North Lebanon Township without first receiving permission from North Lebanon Township.
B. 
It shall be unlawful for any collector to spill or deposit any garbage, ashes or recyclables on any public property highway, street, roadway or alley within North Lebanon Township, and if such event does occur, the collector shall within 30 minutes of the unlawful act notify the North Lebanon Township Police Department of the incident, and the collector shall immediately cause the highway, street, roadway or alley to be cleaned in accordance with the requirements of North Lebanon Township.

All persons within North Lebanon Township having their garbage and refuse collected and disposed of shall comply with the following requirements:
1. 
All garbage and refuse before being placed in garbage and refuse receptacles shall be bagged.
2. 
All refuse shall be drained of any liquid before being deposited for collection.
3. 
Garbage and refuse receptacles, for collection purposes, shall be placed at ground level on the property, not within the right-of-way of a street or alley and shall be easily accessible from the side of the street or alley from which collection is made, except where an agreement exists with the collector to collect from a basement or a porch.
4. 
All garbage and refuse shall be placed in receptacles as provided herein.

All persons being required to have their garbage and refuse collected within North Lebanon Township as provided in this Part shall comply with the following:
1. 
Garbage and refuse receptacles shall be kept as sanitary as possible and shall be thoroughly cleansed by the owner, at least periodically, after collection.
2. 
Garbage receptacles shall be made of metal or plastic be watertight and be provided with a watertight cover.
3. 
The Board of Supervisors of North Lebanon Township shall have the right to limit the capacity of garbage and refuse receptacles. In such case, the same shall be designated by resolution of the Board.
4. 
All garbage and refuse receptacles shall be provided by the owner, tenant or occupant of the premises.
5. 
All garbage and refuse receptacles shall be maintained in good condition. Any receptacle that does not conform to the provisions of this Part 1 or that may have ragged or sharp edges or any other defect liable to hamper or injure the collectors thereof shall be promptly replaced upon notice to do so. Where the conditions of a receptacle is the result of carelessness on the part of the collector, it shall be the collector's responsibility to replace such a receptacle. Failure to comply with such a request will constitute a violation of this Part 1.
6. 
Dumpsters may not be located within the Township or state right-of-way.
7. 
All garbage and refuse shall be placed in a receptacle as described in Subsection 2 of this section at the time that the garbage and refuse is placed or stored outside of a building or residence. All receptacles shall at all times be covered with a watertight cover which shall be sealed so as to allow garbage and refuse to remain inside the receptacle at all times. It shall be the responsibility of the owner and lessee of the real estate to keep all garbage, refuse or other materials at all times within the receptacle, and such owner and lessee shall immediately clean up any garbage, refuse or other items that are outside the receptacle.

Any person who violates or permits a violation of this provision of the Code of Ordinances of North Lebanon Township shall, upon conviction thereof, be sentenced to pay a fine of not less than $100 nor more than $1,000, and/or to be imprisoned for a period not to exceed 90 days, and in addition thereto, shall pay the Township for all costs and expenses relating to any clean-up or disposal expenses as may have been incurred by the Township. A separate offense shall arise for each day or portion thereof in which a violation is found to exist.
