Whenever the owner of any lot or land bounding upon any of the open public streets of the Borough shall permit or allow the sidewalk or curb in front of such lot or land to become in bad order and repair, then and in that case the owner of such lot or land, upon written notice so to do from the Secretary of the Borough, shall repair, replace, reset and put in order such sidewalk or curb. Any replacement shall be in accordance with the specifications set forth in §§ 21-202 and/or 21-203 of Part 2 of this chapter.

Should the said owner or owners fail or refuse to repair, reset, replace or put in order such sidewalk or curb within 60 days after having received written notice so to do, then and in that case the Borough may proceed to repair, reset or replace such sidewalk or curb, or cause the same to be so done, and the cost of such repairing, resetting or replacing of such sidewalk or curb, together with a penalty of 10% of the cost of such repairing, resetting or replacement, shall be collected by the Borough from the owner or owners of the lot or land bounding thereon either by filing a lien or by action of assumpsit or other appropriate action.
