DEALERS IN SECOND-HAND GOODS
Includes any person who otherwise in the normal course of
business purchases personal property not from a retail or wholesale
entity or auction for the purposes of reselling the property.
PEDALCYCLE (BICYCLE)
A vehicle propelled solely by human-powered pedals, having
wheels any of which are over 18 inches in diameter.

No person shall operate or use a pedalcycle (bicycle) on any
of the streets, alleys or highways of the City without first obtaining
and displaying on it a license for it from the City, or another municipality
if required in which he/she resides.

Application for a pedalcycle (bicycle) license and license certificate
shall be made upon a form provided by the City of Lebanon and shall
be made to the Lebanon Police Department. A license fee in the amount
of $2 for a period one year or $5 for a period of three years shall
be paid to the City at the time of issuance.

The City shall provide license decals together with license
certificates, each having numbers in numerical order. The Lebanon
Police Department, or authorized agent, upon receiving proper application,
shall issue a license decal and license certificate which shall be
effective until January 31 of the year following expiration or until
the pedalcycle (bicycle) is sold or disposed of by the owner in any
manner prior to that date.

The Lebanon Police Department, or authorized agent, shall not
issue a license for any pedalcycle (bicycle) when it knows or has
reasonable grounds to believe that the applicant is not the owner
of or entitled to the possession of such pedalcycle (bicycle).

The Lebanon Police Department, or authorized agent, shall maintain
a record of such license, the date issued, the name of the person
to whom issued, the serial number on the frame of the pedalcycle (bicycle)
for which issued and a record of all pedalcycle (bicycle) fees collected.

The license decal as issued shall be firmly attached to the
pedalcycle (bicycle) in such a position as to be plainly visible and
shall remain attached to the pedalcycle (bicycle) until the expiration
of such license.

When any pedalcycle (bicycle) license expires, it shall be renewed
by submitting an appropriate application and paying the required fee.

The Lebanon Police Department, or authorized agent, shall inspect
each pedalcycle (bicycle) before licensing it or renewing a license
for it; it shall refuse a license for any pedalcycle (bicycle) which
it determines is in an unsafe mechanical condition.

Upon the sale or other transfer of a licensed pedalcycle (bicycle),
the licensee shall transfer the bicycle and certificate of license
at the Lebanon Police Department or authorized agent. This transfer
shall be witnessed by an official of the Lebanon Police Department
(licensing officer) and/or authorized agent, the new owner being required
to pay for a new license decal.

A rental agency shall not rent or offer any pedalcycle (bicycle)
for rent unless the pedalcycle (bicycle) is licensed and license decal
is attached thereto as provided herein and such pedalcycle (bicycle)
is equipped with the equipment required by law.

Every dealer in second-hand goods who purchases second-hand pedalcycles (bicycles) shall issue a report to the Chief of Police in accordance with §
315.02 of the Codified Ordinances of the City of Lebanon, Pennsylvania.

Every person operating a pedalcycle (bicycle) upon a roadway
in this City shall be subject to the City of Lebanon Traffic Code
and the Vehicle Code of the Commonwealth of Pennsylvania, both of
which are applicable to drivers of a motor vehicle, except as to those
provisions of the Traffic Code and Vehicle Code which by their very
nature have no application nor pertinence.

(a) No pedalcycle (bicycle) riding is permitted on sidewalks in business
districts in the City. Business districts are defined as follows:
(1)
Cumberland Street from Second Street to Tenth Street;
(2)
Third Street from Chestnut Street to Willow Street;
(3)
Fourth Street from Chestnut Street to Willow Street;
(4)
Fifth Street from Chestnut Street to Willow Street;
(5)
Sixth Street from Chestnut Street to Willow Street;
(6)
Seventh Street from Chestnut Street to Willow Street;
(7)
Eighth Street from Walnut Street to Scull Street;
(8)
Ninth Street from Walnut Street to Scull Street;
(9)
Lehman Street from Second Street to Spruce Street.
(b) It is not the intent of this article to compel young children to
ride their pedalcycles (bicycles) in the streets where they may create
a driving hazard or be injured or killed. Therefore, in areas other
than business districts, and at the sole discretion and responsibility
of a parent or guardian, only children under the age of nine, in the
absence of proper supervision, may operate their pedalcycles (bicycles)
on sidewalks.
(c) Children under the age of nine riding their pedalcycles (bicycles)
on sidewalks or anyone riding a pedalcycle (bicycle) on a pedalcycle
(bicycle) path used by pedestrians shall yield the right-of-way to
any pedestrian and shall give an audible signal before overtaking
and passing a pedestrian.

No person shall remove, destroy, mutilate or alter the number
stamped on the frame of any pedalcycle (bicycle) nor the license decal
on any pedalcycle (bicycle) licensed under this article. No person
shall remove, destroy, mutilate or alter any license decal or license
certificate during the time in which such license decal or license
certificate is effective.

The following streets within the City are hereby designated
as pedalcycle (bicycle) routes:
(a) Eighth Street, from Hauck Street to Maple Street; and
(b) Chestnut Street, from Fifth Avenue to Sixteenth Street.
The routes shall be marked with clearly visible signs.

The Chief of Police shall send to the parent, guardian or legal
custodian of such minor a written notice of the violation of this
article, together with notice to such parent, guardian or legal custodian
that unless the terms of this article are complied with, the penalty
thereof shall be invoked against such parent, guardian or legal custodian
of such minor.

(a) Whoever violates any of the provisions of the Pennsylvania Motor
Vehicle Code shall be prosecuted and penalized in accordance with
it.
(b) Any person violating any of the provisions of this article or of
the City Traffic Code shall be fined not more than $300 and/or be
imprisoned in the Lebanon County Correctional Facility for not more
than 30 days.
(c) Any pedalcycle (bicycle) ridden in this City in violation of Section
523.02 shall be impounded. Starting with the sixth day of impoundment, a storage charge of $1 for each day shall be imposed upon and collected from the owner.
