A. 
All garbage, waste foods, organic matters, glass, paper and all kinds of trash existing on residential premises within the City shall be placed in a heavy-duty plastic bag in a covered galvanized or plastic garbage can, with a maximum size of 44 gallons, except that items segregated for recycling shall be placed in recycling containers obtained from the City.

B. 
Such garbage and trash will be collected by City employees on a weekly basis, adhering to a schedule which shall be established by the Superintendent of Public Works. The schedule of collection may be changed from time to time, and will be adjusted to accommodate holidays or inclement weather. The public will be notified of such schedules by notices posted in City Hall and other public notices from time to time as may appear appropriate, and on the City’s official website, holidays affecting garbage collection.

C. 
For purposes of such collection, residents or property owners shall place trash containers at the curbline of their property not earlier than 6:00 p.m. of the day before the scheduled collection nor later than 7:30 a.m. of the day of scheduled collection. Garbage cans and recycling containers must be removed within 24 hours after collection.

D. 
Residents or property owners shall be responsible that all materials placed for collection shall be contained as provided in Subsection A hereof, and that they remain so contained until collected by City employees.
E. 
Nothing in this chapter shall preclude the provision of contractual garbage and/or recycling collection services, as opposed to collection by municipal employees and equipment. In the event the City shall provide contractual garbage and/or recycling collection services, the dates and times for such collection services shall be governed by the terms of the agreement between the City and any private party providing garbage and/or recycling collection on behalf of the City. A schedule setting forth the dates and times for collection services provided under this subsection E shall be posted and made available at the offices of City Hall.

Recyclable items include nonwax cardboard, newspapers, magazines, clear plastic water bottles, colored plastic bottles, tin cans (paper removed), aluminum cans, junk mail, clothing. Bottles must be clean and empty. Recyclable items will be collected on the regularly scheduled collection day placed in a separate recycling container. Vehicle tires are not accepted for recycle.

The City will make special collections of household items, other than regular garbage and trash and not including construction materials and debris from demolition or lot clearance, from residential properties; such special collections shall be on a regularly scheduled basis, as established from time to time by the Superintendent of Public Works, based on the nature of the items to be collected and the availability of personnel and vehicles in relation to demand for such collections and other responsibilities of the Department of Public Works, and subject to the following regulations:
A. 
Requests for special collections shall be made to City Hall by 4:30 p.m. two days preceding the designated collection day.
B. 
Materials for special collections shall be placed at the property curbline not earlier than 4:00 p.m. of the day before the scheduled special collection nor later than 7:30 a.m. of the day of scheduled special collection.
C. 
Tree limbs, brush, trimmings, boards or similar materials shall be no longer than four feet in length and shall be securely bundled and tied into units weighing no more than 40 pounds.
D. 
Any other loose materials shall be placed in cartons or containers with a total weight of no more than 40 pounds.
E. 
Wood materials and metal materials shall be separated.
F. 
Major items such as appliances and furniture will be picked up with the following fees charged: $5 per chair; $5 per television up to 19 inches; $10 per sofa, refrigerator, stove, dryer, washer, dishwasher, console television or any other large item, etc. No more than two major items shall be placed for special collection at one time. The fee for major items shall be paid for prior to the day of scheduled pickup. No such major item shall be placed or permitted to remain where it is visible from the street until the time for placement for collection as provided in Subsection B hereof.

G. 
A maximum of one pickup truckload of material will be collected in any one special collection. In the event that an amount greater than one pickup truckload is placed for collection, a fee will be charged to the resident calculated to defray the City's landfill expense relating to such excess amount of material; such fee, if unpaid, shall be a charge against the subject property.
H. 
Special collections are intended to accommodate normal and reasonable accumulations of materials arising from residential use properties in the City, including materials from seasonal cleanups and from limited repair and remodeling projects. The City will not collect materials arising from work or projects performed by contractors or by an owner acting as a general contractor for the work or project.

The occupants and the owners of all properties in the City shall be responsible for compliance with the provisions of this Chapter 58 of the Crisfield Code.

A violation of this Chapter 58 of the Crisfield Code shall be a municipal infraction and the provisions of Chapter 10 of the Crisfield Code shall apply.

A. 
Each residence or residential unit, as defined below, shall be assessed and shall pay the City of Crisfield a garbage disposal fee of $14.40 per month for one ninety-five-gallon can. Up to two additional garbage cans may be added for an additional fee of $14.40 per month, per can.

B. 
Businesses and other nonresidential users may arrange for the City of Crisfield to pick up the garbage which they generate by contacting the City and paying the disposal fee of $14.40 per month. Upon the making or arrangements for the same, the City will extend the same garbage collection services to the participating business or other nonresidential user as are extended to residential users, it being specified, though not by way of limitation, that pickup for a business or other nonresidential user shall be no larger than that which would be accepted from a residential user, i.e., trash contained in a ninety-five-gallon can.

C. 
The disposal fee of $14.40 imposed herein shall be added to the user's monthly water and sewer bill.

D. 
Failure to pay the disposal fee provided herein shall entitle the City of Crisfield to suspend trash pickup for the user failing to make payment.
E. 
The disposal fee imposed herein shall be subject to change within the reasonable discretion of the Mayor and Council of the City of Crisfield.
F. 
A "residence," as used herein, shall be defined as a building used for human habitation, residency and/or domicile and billed by the City of Crisfield for water service. A "residential unit," as used herein, shall be defined as a portion of a building, which said portion is used for human habitation, residency and/or domicile and is separately billed for water service by the City of Crisfield.
G. 
Nothing in this chapter shall preclude the provision of contractual garbage and/or recycling collection services as opposed to collection by municipal employees and equipment. In the event the City shall provide contractual garbage and/or recycling collection services, the dates and times for such collection services shall be governed by the terms of the agreement between the City and any private party providing garbage and/or recycling collection on behalf of the City. A schedule setting forth the dates and times for collection services provided under this Subsection G shall be posted and made available at the offices of City Hall.

Private individuals or firms engaged in the business of refuse collection in the City of Crisfield or who may use the streets of Crisfield for the transport of these materials shall be subject to all federal, state and local laws, ordinances, codes or regulations applicable to the operation and maintenance of motor vehicles, including air and noise pollution laws and regulations.
