It shall be unlawful for any person under the age of 21 years to possess, with intent to consume, any alcoholic beverage as defined in § 3 of the New York Alcoholic Beverage Control Law and any amendment thereto, unless such alcoholic beverage has been given by the parent or legal guardian of such person, and such person is accompanied by such parent or legal guardian.

In addition to the provisions of the Alcoholic Beverage Control Law § 65-c, violation of this article shall constitute a violation as defined in the Penal Law of the State of New York and shall be punishable as such.
