The purpose of this zoning district is set forth in §
27-308, Subsection
1, of this chapter.
1. Use Regulations. A building may be erected or used and a lot may be used or occupied for any of the following purposes, and no other, subject to the applicable provisions of Part
6, General Regulations, and other applicable provisions of this and other Borough ordinances.
A. The following uses are permitted by right:
(1)
Single family detached dwelling.
(2)
Public park or playground.
(3)
Electric substation or automatic telephone exchange without
rotary converter or generating machinery. Outdoor storage and garaging
of motor vehicles shall be prohibited with said use.
B. The following uses and their accessory uses are special exception uses and may be permitted by the Zoning Hearing Board following review and recommendation of the Planning Commission in accord with Part
10 of this chapter.
(1)
Public or private educational institution or use, including an elementary or secondary school or kindergarten, but not a business school, trade school, dance school or similar use, subject to §
27-1003.
(3)
Church, rectory, or parish house subject to §
27-1003.
(4)
Bed and Breakfast home subject to §
27-1004, Subsection
7.
C. Accessory uses on the same lot and customarily incidental to the
permitted use are permitted by right. The term "accessory use" shall
not include a business but may include:
(1)
Private parking space or private garage, private garden or home
swimming pool.
(2)
Home professional office, if located in a dwelling in which the practitioner resides, and occupying less than 25% of the floor area of the building subject to §
27-612.

1. Land and buildings in the MU Districts shall only be used for these
purposes, and shall comply with all other applicable requirements
of this chapter:
A. The following uses are permitted by right:
(1)
Single family detached houses, two family dwellings provided
each dwelling is separated by a vertical wall, multi-family dwellings
provided each dwelling is in a townhouse arrangement separated by
a vertical wall.
(2)
Multi-family dwellings that are not in a townhouse arrangement
and which have at least one street level principal commercial use.
(3)
Public park or playground.
(4)
Nonresidential uses as set forth in the Table of Nonresidential
Zoning District Use Requirements.
(5) Academic clinic research centers, subject to applicable performance standards in §
27-6A01, Subsection
2.

B. Additional Special Exception Standards.
(1)
As a condition of a special exception use proposed within 200
feet from an existing dwelling that will involve truck traffic or
operations perceptible to residents of dwellings between the hours
of 9:00 p.m. and 7:00 a.m., the applicant shall describe the extent
of such activities in the application. The Zoning Hearing Board may
place reasonable conditions upon such activities and operations to
provide compatibility with nearby dwellings.
(2)
The Zoning Hearing Board may deny a special exception application
if credible evidence is provided that the proposed use would create
health or safety hazards to residents of nearby dwellings.
C. The following
conditional uses are permitted:

(1) Zero-lot-line subdivision.
2. Parking, Loading and Sign Regulations. Parts 7 and 8 shall apply,
except that signs in the MU Districts shall comply with signs allowed
in the C-2 District.

The purpose of each nonresidential zoning district is set forth in §
27-308, Subsections
4 to
9, of this chapter.
1. The table in this section of this Part designates the land use allowed
in each nonresidential zoning district. A use is allowed only if designated
by a P or by an SE in the table. All uses not so designated are prohibited.
2. CU, P and SE are defined as follows:
CU — Conditional Use is a use that is only allowed in a district if conditional use approval is granted by the Borough Council under §
27-1206. Prior to Borough Council action, the Borough Planning Commission shall be given an opportunity to provide a recommendation.
P — Permitted Uses (permitted by right as approved by
the Zoning Officer or as otherwise specified in this chapter).
SE — Special Exception Uses (permitted by the Zoning Hearing
Board following review and recommendation of the Planning Commission).
3. All uses permitted as special exception uses are subject to the provisions of Part
10 and any other applicable provision of this chapter.
4. The regulations pertaining to minimum land or lot areas and other dimensional requirements for uses in nonresidential zoning districts are set forth in Part
5 of this chapter.
