No plan of a subdivision of land within the boundaries of the
Town of Casco which would constitute a subdivision as defined herein
shall hereafter be filed or recorded in the Cumberland County Registry
of Deeds until a final plan thereof shall have been approved by the
Planning Board in accordance with all of the requirements, design
standards and construction specifications set forth elsewhere in this
chapter, nor until such approval shall have been entered on the final
plan by the Planning Board.
No person, firm, corporation or other legal entity may convey
or offer or agree to convey any land in a subdivision unless that
subdivision has been approved by the Planning Board and the approved
subdivision plan has been recorded in the Cumberland County Registry
of Deeds.
Any person, firm, corporation or other legal entity who or which sells, leases, develops, builds upon, or conveys for consideration or offers or agrees to sell, lease, develop, build upon or convey for consideration any land in a subdivision which has not been approved as required by §
210-10.2 above shall be punished by a fine of not more than $1,000 for each such occurrence. The Planning Board, the Code Enforcement Officer or Selectboard may institute proceedings to enjoin violation of this chapter.
Except as provided in §
210-10.3 above, any person, firm or corporation being the owner of or having control or use of any building, structure or land who or which violates any provision of this chapter or any condition imposed by the Selectboard, Code Enforcement Officer, Planning Board or Appeals Board pursuant to the provisions of these regulations commits a civil violation and shall be liable for a civil penalty of no less than $100 and no more than $2,500 for each violation. Each day such violation is permitted to exist after notification thereof shall constitute a separate violation. All penalties collected hereunder shall inure to the Town.
No public utility of any kind shall serve any lot in a subdivision
for which a final plan has not been approved by the Planning Board.
Not only is making a subdivision without Planning Board approval
a violation of law, but so also within such a subdivision or potential
subdivision site is grading or construction of roads, grading of land
or lots, or construction of buildings until such time as a final subdivision
plan shall have been duly prepared, submitted, approved and endorsed
as provided in these standards, and until the original copy of the
final plan so approved and endorsed has been duly recorded in the
Cumberland County Registry of Deeds.
Where a provision of this chapter appears to be in conflict
with any provision of any other ordinance, rule, restriction, or statute,
that provision which imposes the greatest restriction and/or provides
for the lesser density of land shall have precedence.
The invalidity of any section or provision of these standards
shall not be held to invalidate any other section or provision of
this chapter.
